To qualify for the OEM operating system you need to purchase one of the following items at the same time ;
CPU, Memory, HDD Motherboard, PSU, or a Chassis.

It used to also be keyboard/mouse/floppy, does this not qualify anymore ? surely a floppy atleast should qualify as its an internal component ? cpu cooler could also be argued, as that may also be used in the final build..

Yes, then Microsoft realised that people were taking the mickey and put in a clause to stop people getting something cheaper than intended.
Unfortunately the middle-man is firmly enshrined in the world, people who purely make money by putting themselves between the manufacturer (in this case Microsoft) and the consumer (us), therefore Microsoft has to give the middleman a profit margin instead of simply selling at one price to everyone.
I'm sure you can buy systembuilder packs without hardware. I have done in the past - they come in a brown box, and when you open that you take on the agreement that Scan have done - ie you can't sell it without hardware.
Yea mine came in a white pack and I can't remember buying any hardware with it. Nothing integral anyway. I don't think...
