RMA Query, hoping for a replacement

Sent a message to ChrisP with the same contents, but thought I should post here as well. I won't post the invoice number here but if you need it please message me.
Basically my brother has had the 8800GTS 320 for around 2 months and has been consistently unimpressed with the performance... So I have been given the task of sending it back and upgrading it to a HD2900XT (with the difference of the price being debited/credited from my card), problem is that since it is past the first month I am apparently unable to get any refund or upgrade even if the card is faulty. I need to get the HD2900 for my brother as I'm sure you can imagine my parents are not happy that my brother is not happy (if you get what I mean), if I had known within the first month that it was purchased then I would have contacted you guys quicker but since he has had exams and revision and all that he has only recently been able to play games and so the problem has only just cropped up.
Is there anything you can do?
8800 GTS 320 - that my bro wants changing -

HD 2900 XT - the part that he wants to upgrade to -

I'd advise E-bay. Sell the 8800GTS and purchase the new card.

If the card has always been faulty then getting a refund within 6 months should be no problem. If it develops a fault then that's a warrenty issue that will normally result in a repair/replacement. But I'm a little bit confused, is it actually faulty or do you just want a better card?

If it is faulty then it would be a lot simpler to send it off for testing and ask for a refund, then buy the new card (delays things buy a week maybe but a lot simpler).

If it isn't actually faulty, just not as good as you'd hoped, then the only real option as it's been opened and used is to sell it on ebay/hexus forums/elsewhere. The performance shouldn't be sloppy though, unless it's being bottlenecked by a very low end CPU or something else in the system?

Sorry but lol, you want them to swap the card because you are not happy with its performance? I don't think you are going to have any luck here buddy, because that quite frankly is a rediculous ask.

IF it is faulty - ie cooler isn't making proper contact causing the GPU to thermally throttle, or its artifacting in games, then yes, you would have grounds for an RMA. However, as has been said, if you bought it, and it doesn't perform in your PC as well as you think it should, then that does not necessarily mean that it is faulty, and you run the risk of NFF and having it returned.

    Just a heads up.

Lol, imagine if you really could return because you were unhappy with performance. No computer company would ever make any money. Am I misunderstanding this though like everyone else or is the card REALLY faulty?

I don't think it is a hardware problem but performance in games is not what I was looking for..... Although it does run fine without AA/AF but I was hoping since I'm a regular customer at scan that they would be able to help me out....

Probably out of luck there. No harm in asking though (dispite the minor flaming which is best ignored). Is the card by any chance from eVGA (can't find anything from the line number)? If so they have a step-up program which might suit your needs. The card is pretty much top end already though, what mobo and CPU do you have?

If you are running at a high screen resolution then you are better off with a 640MB card. Can't say I've ever had the luxury/budget to run AA/AF on anything but old games with my graphics cards. I just like to set the resolution to my monitors (1280x1024) and drop the settings till the fps is playable.

If you have the cash to burn then sell and buy a better one. There will always be a better card though, and the GTS is a fine one, so maybe just save some money and upgrade with the next generation. Life isn't that bad with slightly rough edges...

I wouldn't sell it, it might be the drivers that are making the card under perform and what OS are you using as if it's Vista then it will be the drivers as they aren't very good at present. Also there are any games that make use of these card's wait untill DX10 games are out and the drivers mature and you should see the benefit's of your card.

Nah I'll sell it, it's a damn good overclocker and it's running fine at the bios settings I ran it at: 600/1400/950 so it's out of here. I think the amount of RAM was holding me back... And if the drivers aren't mature by now then I don't know how much longer they will take to mature.... Don't get me wrong performance is good without AA/AF but with it performance drops considerably. Albeit not as much at overclocked settings
