Have I received a second hand XFX HD 4890 Black

I'm having trouble with installation of my new XFX HD 4890 Black and when I tried to register with XFX it said "Sorry this card is already registered"

When I received the card the outer packaging was fine but the box was damaged and had been opened, I've just tried to install it and the screen went black, but the system was still running as it shut down normally when pressing the power button, when it restarted it was OK for a minute then I just got white and pink blocks all over the screen, I uninstalled the drivers and tried the drivers off the CD and it asked me to register, when I tried it told me the the serial number of the card card was already registered.

Now I've finally got the card to install but can't get the CCC to open at all, again I've removed and reinstalled the drivers using the latest drivers and it seems to install correctly but CCC won't run.

Damaged packaging and the fact the card is already registered along with the fact the card is still pre order on Scan.co.uk and I received an email a week ago saying it will be at least 3 weeks leads me to believe the card is a return thats been sent to me.

Could I get Scans view on this as it appears I may have received second hand goods.
