    Returning opened GFX card under DSR

    I has anyone had any experience of returning a GFX card within 7 days under the Distance Selling Regs 2000/2005 ?

    Thing is I just bought a GTX 480, opened and installed it, then went bloody hell thats noisey
    The missus agreed and also found it very annoying and distracting when she was trying to do others things and i had the comp running.

    So I basically can't have it, its just not suitable.
    It has been opened and used for an hour or so.
    Therefor the seal on the anti-static bag is broken and the small secutiy seal on the box (obviously to get the card out)

    The box, packaging and rest of contents are all unopened, and obviously the card is in pristine condition still.

    I know i have to pay return postage, but will i get a full refund back or will Scan try to charge me some "restocking fee" (which i'm lead to believe is against the DSR 2000 anyway)

    They have to give you a full refund if you reject under the DSR in writing (email or post). It does not matter why you want to return it, they are legally obliged to refund 100% of the bill including postage. You will have to pay for return postage though.

    its more the fact that i've opened and used the card which i'm unsure about.

    As long as you haven't physically damaged the card itself - specifically taken reasonable care of it, you'll be fine. Echoing SiM's comments.

    Just an FYI, the HD5870 is a lot quieter than the GTX480, and a lot cheaper as well, performs pretty close to it.

    I know, don't get me started on that.

    I bought a 5870 2Gb Vapor-X from AriaPC three weeks ago from £352.
    Last week it died so I sent it back for a refund.

    I got a 480 this time, from Scan, cos I bought all the hype with the 275.XX series drivers and saw these Inno3d ones at nice price (£393)
    Big mistake.
    Its not really any better, in fact although the framerate is higher on most games on the 480, the 2Gb 5870 felt smoother.... particulary in BC2.
    The extra noise and power just aren't worth it for 5-10fps.

    Now I want a 2Gb Vapor-X again - but the bloomin prices have gone up everywhere inc Aria to £370 +

    Oh I wish I could go back time to last week.

    Ah well you live and learn. Only fools rush in.

    wow, I never saw them anywhere near as cheap as £352, had I seen that I probably would have bought two there and then
