Scan returns policy on used items
I recently purchased the xfx 5770 from scan and find it not powerful enough and would now like to return it for a refund. I received the card last friday (15th), will scan accept this return? From what i believe, I have 7 days from delivery to decide if i want to keep the product. Is this correct?

Box it back up CAREFULLY, then yes you should be able to return it.
It's 7 business days from when you recieve it.

yes you have to say you want to return it under DSR
then you will be responsible for returning it (and insuring it for return journey if its valuable).
the goods should not be unduly worn or damaged beyond what would ensue from 'reasonable inspection', otherwise the retailer can reclaim damages from you after refunding you.
be careful of the packaging as meaker says
a return was denied recently because of damaged packaging, although that decision is questionable under DSR terms. its less hassles all round to keep it good condition of course.

A retailer cannot use the condition of packaging alone as an excuse to refuse a refund. This is clearly stated in the DSR.
If Scan are doing this then the customer needs to contact trading standards and/or seek legal advice.
A friend of mine had a similiar issue recently with another online retailer who refused point blank to refund him, until the trading standards people reminded them what the law states :)
Having said that, I am always particularly careful with any packaging until I am sure I am going to keep the goods because I know how I would feel ( although still required by law to give a refund ) if a customer of mine returned goods in a trampled/torn box or packaging.

Exactly yet many (usually smaller) retailers try to do this and demand it be unopened and unused.
Also I am sure there are as many 'bad' customers who trash the packet, use the item heavily for 5 days and then still demand a full refund!
I agree with the sentiment I certainly would not like someone to bring back an item just as 'unwanted' with unnecessarily damaged packaging.
A little common sense when opening and returning makes everyones lives easier!

The term "goods" is always a interesting one.
Personally, that is the item in question, once removed from its packaging.
Doesnt mean you shouldnt keep reasonable care of the packaging, its just that some packaging is nearly impossible to get into and almost certainly cant be reused to sell the item.

I pinched the following quote from a post in the 'after sales' section.

I'd say that you couldn't get much clearer than the bold text above. By law the retailercannot insist on the original packaging :)

I agree.
Especially some of those totally sealed, military grade plastic clams some products use!
Great to prevent petty theft, but you really have to hack into some of them and they are not environmentally friendly at all (no chance of them decomposing in the next century or so!)

intresting...i wish i knew that when i bought a motherboard from a un-named online store (not scan) lets just say i was over 200 out of pocket and not happy lol

Some of the less reputable places arent keen to advertise such info, and you can see why.
However, they are required to by law, and provide specific ways to contact them as well.
Often a good beating from Trading Standards, plus obligatory news articles, gets them in line.
That said, sometimes its a mistake, either they thought they provided enough information, or a member of staff wasnt fully aware of the law.

The original intention of the DSR was to allow the customer the same ability to "inspect" the goods as they'd have in a shop. Whilst you'd possibly be able to open and look at a product in a shop, they're not going to let you actually use it and then just hand it back saying you don't want it any more.

It's considered part of the "risk" of being an online retailer and a responsability for them to bear.
