Faulty R9 290x?

So it looks like unfortunately I have got a faulty one, I did see Toms Hardware have this issue but must be more widespread than thought.
Basically its throttling massively under full load and the fan is going like a hairdryer!

Whats the best course of action on this, I doubt there is a fix so a swap out, can you garentee a replacement will not be faulty?
