Over credited, Reported, Retailer not done anything

I bought a couple of items from a retailer and they charged my credit card twice, after I complained they credited my cc with the amount they owed me.
A little while later I noticed something odd, my cc balance was going down ! I checked my account and the same retailer had credited me with the same amount they had previously on Monday through Friday for a grand total of approx £55 miscredited to my cc.
I reported this to the retailer immediately and they stated that it was a known problem and when I asked them what to do they said they would be in contact with me.

Its now seventeen months later, what responsibilities do I have regarding this amount ?

Isn't there some "year-and-a-day" law for things like this? Like if they haven't sorted it out after 366 days then the money is yours whatever?

Maybe I just made it up

my step dad is a magistrate and there have been a couple of times where he has bought things and theyve not charged him. being a magistrate hes very honest and has rung them to tell hthem but theyve still not debited his card, and he has just left it. if someone who knows the law and decides peoples sentences like he does keeps it quiet. i would.

Re: Over credited, Reported, Retailer not done anything

Well they have my address and phone details and haven't made any attempt to contact me in the intervening time which is making me think I should just forget about it. What's bothering me is if they come looking for it years later, maybe I should contact my credit card company to see what they think my responsibilities (if any) are ?

You have done all you need to. That does not make the money yours. They can come back and reclaim it.

Re: Over credited, Reported, Retailer not done anything

Theoretically, they could come after you for the £55. Legal action can (England and Wales, but a bit different in Scotland) generally be taken for 6 years, but after that, courts won't enforce debts. But there are (or certainly used to be, though I haven't checked for some years) exceptions. One was if the debtor confirms the debt as outstanding. For instance, as part of an audit, auditors send out debtor and creditor circularisation letters, simply asking the recipient to confirm that the amount recorded in the books reflects reality. And if a debt gets confirmed, it resets that time clock. That's not likely to happen here, though, and if it was going to, the odds are it already would have. And you can just ignore that letter anyway.

So I'd say it's possible you could still be chased. But after 17 months, and over £55, and given the nature of the cockup, I'd say it's a VERY long shot that you'll hear any more.

So .... if your conscience is comfortable with it, the odds are you'll never hear any more. And when all's said and done, it's only £55, so if you do get chased, either pay up or play stupid, according to your inclination. It's not exactly a huge sum either way.
