No. Consumers are under a duty to take reasonable care of the goods while in their possession as discussed in paragraph 3.44. The DSRs allow consumers to examine goods they have ordered as they would in a shop. If that requires opening the packaging and trying out the goods then they have not breached their duty to take reasonable care of the goods. In these circumstances you cannot insist that consumers return the goods as new or in their original packaging. You may ask consumers to return goods with the original packaging, but you cannot insist on this.

This company will sell your email address. I always use a unique email address with every company I do business with and the address used with this company is now being bombarded with spam and phishing messages from various banks . . . . .
I think hes saying if you did a lot of online purchasing you would have literally hundreds of email addresses. Which is a pain to keep track of and keep setting up (well not necessarily, but i think that's his point).
I too use such tailored email addresses and have done for around 5 years. It isn't a question of setting up separate email addresses - you simply set up a catch all redirect on your domain so that *@itrustnobody.co.uk gets redirected to a real email address. When filling in webforms, you tailor the address to the site/company. So spam arriving on an email address like this one:
ginger6@itrustnobody.co.uk
enables you to have some idea of its origin.
In 5 years I never actually received anything of any note on a tailored email address - until I shopped at ginger6 that is. Then a flood of phishing emails.
I bought an Asus DVD DVD-E818A of them in November 2007, no problems with them, and if I thought they could supply me with something at a "good price" I would certainly use them again....

Hi guys, I would like to set the record straight on some of the comments above.....
Here at Ginger6 we spend an awful lot of money to attract new customers, so our customer database is extremely valuable to us, and has taken a long time and a lot of hard work to accumulate.....the suggestion that we would be willing to sell that data is absurd.....
We have however had issues with security, and it appears that at some stage our customer database has been compromised, ie directly from someone hacking our website.
I would just like to stress that we do not hold any financial data relating to our customers on our website or within our database, and those customers who have used our website will know that all payments taken are handled by external payment processors, so we never see any financial data on the website.
We have taken the comments above seriously, and a lot of time and effort has gone into making sure our website is now secure, we have forced our hosting company to upgrade servers and software to tackle some security issues, and we have taken on the services on McAfee Secure (formally Hackersafe) to check our website daily for any vulnerabilities.
I know some of you will say it is too late, that the horse has bolted....but we are constantly battling the spammers and hackers in this world, and unfortunately they are usually one or two steps ahead. However I am sure that all holes in our armour have been plugged, and we will endevour to make sure it stays that way.

I don't know about anyone else, but I really appreciate you taking the time to write your response to this thread.
Having looked through it again, there are a few members that have only commented on this one thread, so I would suspect they have been trawling the internet for outlets for their feelings towards your company. This is a shame really.
It also takes a lot for companies to admit to previous problems, any realistic person can appreciate that no company is perfect. But one willing to admit to issues and are willing to address those issues are few and far between, and worth giving another chance with our custom.
Hexus has always welcomed retailers or ventors Right To Reply, Ginger6 is no exception.
Perhaps we will see you around the forums more?
