using a wifi equipped phone as an access point for itouch

Most phones allow you to use them as a modem via cable connection or bluetooth. Unfortunately the ipod itouch does not officially suppport bluetooth (was it disabled?)
I have both an N95 and a HTC Kaiser/vario 3/tytn2 can either of these be set up to be a wireless access point?

(ie connect to the 3G network via wifi)

of course apple don't want people to be able to do this because it would obviate the reason to buy an iphone!-presumably why bluetooth disapeared from the itouch spec

Yes, you can with the Vario 3 I think. Have a look on xda-developers, someone posted the steps to do it. I'll have a look and try to find the thread.
