I agree, the law does seem to be on your side, and it's hard to see how you can damage the inside of a switch ... though perhaps, dropping it and it landing on the switch might do so. Or, perhaps, the shock of dropping ... or more specifically, deceleration when it landed, might too.
Even then, you could perhaps argue that if this was just normal usage, such damage perhaps indicates poor quality components unable to withstand predictably normal usage, and if so, that would probably still give you a case. In any event, it's for them to prove its your fault, not for you to prove it's theirs, given the age of the phone.

i agree, i want to see them prove its my fault, and the phone was not dropped, of course they dont know this and only have my word for it! But, still if they did argu this, then where are teh marks to prove it was dropped? IMHO i dont think they have any leg to stand on really...
