    3 mobile contract

    Hi
    Have a problem. My 18 month contract with 3 comes to an end on 22nd October 2011. I have been in contact with them since May on a couple of occasions enquiring about this. Today I spoke to them again saying that I would not be renewing my contract when it ended. After offering me all sorts of other deals, some of them good I have to say but I don't like being tied into such long contracts, they then informed me I am too late to cancel as I have to give them 30 days notice !!!!!!!!!! Why do I have to give notice to end a contract that I have contracted to be only 18 months long? If the contract ends on 22nd October 2011, why should they need notice that it is going to end?

    Sorreee steam coming out of my ears at present. After reading some posts it looks to me as though this is what mobile companies do, I am a bit long in the tooth. I did study law for awhile, and silly me I thought the end of a contract, was the end of a contract and did not need ending !!

    Anyway if I cancel now, what is likely to happen? Will 3 try to tie me into another long contract? Will they try to charge me extra for not ending the end of my contract (that is just soooo weird and wrong sounding) by giving them 30 days notice?

    Give them 30 days notice now and then it'll be ended on the 1st of November.

    Logically, if the contract ends, it ends.

    But, you need to check the original terms of the contract, only that will tell you what happens if you dont cancel at the end.

    If it says something like "if you dont cancel at the end of the contract, we will automatically sign you up to a new one", you could always try to argue unfair contract terms.

    There was something recently about companies automatically entering you into a new contract if you did nothing, but I dont recall if it was a legal thing, or the start of some lame investigation.

    They're talking bollocks. The end of your contract means that you can cancel at any time after that unless you've accepted and received an upgrade. You do have to give 30 days notice still but that just means that you'll be with them for a few weeks more

    They are pulling your leg.

    When it comes to cell phones if your contract ends then you move onto what is known as a rolling contract which is on month-to-month basis until you give them your notice [it's not fixed] and ask for your code if you want to keep the same number.

    Expect some calls from them trying to entice you into a new contract. They have poor customer service..

    I'm now paying £18.75 a month for 900 minutes, 1GB of internet, 5000 texts, 5000 3-3 minutes and an iPhone 4.

    That's pretty good customer service if you ask me.

    And to top it all off, the reception issues have actually got a lot better recently

    Sorry but thats wrong.
    Their terms state that if you do not give 30 days to cancel, whether its the end of the 18 months or not, you go onto a rolling 30 day contract.

    The best thing to do, is cancel with 30 days to go.

    Similar to me.
    I am in an area where they took down the 2G signal.
    Called them and they looked into it.

    3 days later they said I could cancel, or they would discount.

    I have:
    iPhone 4 on the One Plan
    2000 X mins
    5000 texts
    2000 3 to 3 mins
    Unlimited Data

    Was £45
    Now £18.50

    100% guarantee O2 or Voda would not do that, and my signal on 3G is fine wherever I am.

    I moved to 3 a few months back and have been really impressed with the speeds and coverage (although I appreciate this is always very subjective).

    Thanks to everyone for all your posts.

    What I did was to contact them by phone to give notice. Reluctant to let me go, they kept offering me different deals - some of them pretty good I have to say! But after about fifteen minutes I was exhausted and said I would let them know. Then I immediately wrote to their customer services and cancelled that way. I also cancelled my direct debit with them and told them I had done the same with my bank.

    They still contacted me and offered even better deals! However I stuck to my guns and eventually was able to get off the fone to them. They sent my PAC code by text about ten minutes later.

    My difficulties with 3 was that I do not like being tied into a contract, as I use a mobile very little and I prefer PAYG. And I was concerned they would try to charge a fee for my not giving them adequate notice, but in fact once they accepted I was going to leave they gave me a £5.00 discount for being a good customer.

    I found a company Giff Gaff, that provide 250 talk minutes, unlimited texts and unlimited internet (if you get to 20 gb they just check with you, but you can use more!) and this for £10 a month with what they call a goodybag. It is PAYG, so no contract, and of course no-one else can offer this deal to me.

    Automatic renewing contracts will be illegal soon. Can't remember the exact date but it is before the end of this year. And it is for existing and new contracts.


    So again thanks for all the input.

    a quick update. I eventually received a final bill from 3. However, they had added another £4.00 as they did not cancel my contract for almost three weeks after my letter to them !! As I had cancelled
    my last direct debit and asked them for a final bill I was able to point out that I had cancelled in writing much earlier, that they had given me a discount of £5 and so they had made a mistake and overcharged me. So I took off the £5 discount off my last monthly payment and sent them a cheque for the remainder. Clearly although I had cancelled in writing they did not accept that cancellation and have tried to charge more. The eventual overcharge would have been £9 and this mounts up if they do it to everyone.

    So be careful out there and watch your back anyway.

    Shows how helpful cancelling in writing can be - far easier to prove dates than things done over the phone. Same with any offers - always get it in writing before accepting, as otherwise you might end up with something that you didn't agree to.

    You'll find Giff Gaff very good, I ditched my Orange contract to go over to Giff Gaff, you won't find many other better deals than what they do for £10 !

    When I told Orange about the deal, they said they could do the same for £10 a month on a 12 month contract and I said thanks but not thanks, they even said I'd never use the unlimited date on Giff Gaff and 500 meg would be enough for me, I said well the only reason I never really used more than 500 meg on Ornage because they're signal on 3 G and HSDPA was so poor, that put an end to that argument !

    What's not clear is at what point you used the PAC code. You will be billed by Three up until the day the number transfers to the new network.

    Hi everyone,

    Regarding the PAC code I used it on 20th October. But there is nothing in their t&c that mentions transferring of the PAC code being the actual cancellation date.

    Well, that means that end of contract, does not mean end of contract and cancellation does not mean cancellation for mobile companies

    They have since written to me suggesting that I was unaware of the VAT increase this year. First what has that to do with the price of fish? And second, why would I not be aware? I have been paying the extra since January !
    Also they write in such a way that leads me to think that they do not know their own t&c well enough.
    But they say that they will apply 'exceptional circumstances' and waive the £4

    Well that's good and patronising of them since I do not owe it anyway. According to their t&c even if full 30 days cancellation is not given at the end of the term of contract they do not charge more.

    I had been quite happy with 3, until this fiasco. Just shows that all these rolling contracts (they seem to be more prevalent in the USA) are a minefield. Glad they are becoming illegal and that the end of a contract is just that.
