    Is vista upgrade oem or retail?

    I'm looking at these two in specfic:
    Microsoft Windows Vista Home Premium - Upgrade package - 1 PC - EDU - DVD - English - English International - Ebuyer
    Microsoft Windows Vista Ultimate Upgrade

    Can I re-use these when I reformat or when I get a new computer? (of course not on old and new computer at the same time)

    afaik upgrade licence requires a previous retail (not oem) OS licence although I believe it is possible to get it to work on an oem OS install.

    An upgrade keeps the orignal licence. Ie. you upgrade from an OEM, your current is an OEM, same if you upgrade from a retail - you get a retail install IIRC.

    You are upgrading the operating system, not the licence that's attached with it IIRC.

    What you linked is also a EDU version - Educational.

    Microsoft Windows Vista Home Premium Upgrade (Educational) - You may need to prove your academic status.

    actually you are, it invalidates your previous licence key
    Iirc the eula upgrade is supposedly only valid with a previous retail install (let's face it a new oem Vista OS licence is 1/2 the price of an upgrade anyway).

    I never mentioned anything about the validity of using a previous XP install with an upgrade, only that the licence 'type' (be it OEM or Retail) depends on what type you're upgrading from as I understand it.

    I'd be very surprised if the upgrade was OEM only considering that probably 90%+ of Windows licences are OEM. We really need to dig out the part from the EULA to find which is correct, which is harder to find than I thought :s

    MS don't make it easy to find out the EULA do they?

    Retail Software License Terms
    Comes up with a 13 page document, which clearly doesn't look like the full EULA.
    Only thing in there is:

    13. UPGRADES. To use upgrade software, you must first be licensed for the software that is eligible
    for the upgrade. Upon upgrade, this agreement takes the place of the agreement for the software
    you upgraded from. After you upgrade, you may no longer use the software you upgraded from.
    Not much help for what we want :\

    I guess this means if you upgrade oem xp to retail vista it becomes retail vista?

    you are upgrading the licence

    what's the point in buying a retail upgrade licence though when an oem licence is 1/2 the price ...

    but I agree that finding the relevant section in Microsoft docs. is not an easy task

    surely its worth upgrading if you are a student and can get it for £54.99?
    OEM is more expensive afaik, but only £1.11 more expensive:

    Is the edu version the same? other than the fact you need to prove you are a student...

    Ah yes, I meant to say licence type, you know what I blinkin mean Buff

    As for the reason: Probably a case of covering two bases at once. Why not offer an upgrade to the OEM version at the same time as the retail?
    Oh, and can a non-upgrade disk upgrade a previously installed version, or does it have to be a fresh install? I would assume that it can upgrade without an issue, but I'm not 100% sure as I've tried to avoid Vista.

    More Importantly - keep in mind that an OEM version is supposed to be brought with valid hardware. You do not have that restriction with an upgrade disk.
