does anyone know if the data migration will copy from a larger SSD to a smaller one if the amount of actual data will fit. ie if I have only used 200GB on a 500GB or 1TB drive can I clone it to 250GB EVO?

to the best of my knowledge having closed 500Gb HDD to 240Gb SSD, yes this isn't an issue.
I used EaseUS ToDo, which you can get a free version of here in case you're interested:

It looked like it could do that, and I did once clone from a 500GB hdd to a 500GB SSD so there is a 50/50 chance the destination was slightly smaller. I haven't tried such a big drop though.
You could always shrink the partition on the old one before imaging
I would be quiet happy to do a clean install of win 10 on the new drive but worried about activating it
