    Faulty refurbished OCZ SSD - Third time!

    Hi,

    About six months ago, I purchased one of your OCZ Vector 240GB refurbished SSDs. It lasted nearly 3 months, then I had to return it as faulty. At much the same time, I bought a second one. When the new one arrived it was DOA, so I had to send it back too. Then the replacement for the first one arrived (December), and it is also now entirely dead after a few corruption errors. (My brand new 120GB SSD is still working fine after 2 years).

    I understand that the warranty period on the refurbished items was listed as 3 months, and about 4 months has passed since I got the last replacement. But I'd still like to return it under warranty please. I have no confidence in OCZ's refurbishment program, as not one out of the three I have been sent, has lasted longer than 4 months!

    I'd be happy with a credit for the purchase price, or a swap out for another SSD of another brand with similar specs.

    Sorry to hear about the problems, can you please provide the manufacturers serial number for the drive in question as I cannot find any returns against the invoice number provided.

    Hi,

    Yes, the serial number is A21K4011339000019.

    My 2 RMA numbers for the 2 returned so far, were: 321190 and 321778.

    Just a reminder that this isn't the unit that was originally sold to me, it is a unit that was supplied as a replacement. I do not have a record of the no-charge invoice or d-note that would have accompanied it.

    Hi,

    Having checked, that serial number relates to a replacement for a drive supplied originally at the start of September 2013 and returned in November for replacement.

    As such I am afraid unfortunately we would be unable to accept return of this item as it is not longer covered by OCZ under warranty.

    Regardless of the 90-day warranty period offered by OCZ, I intend returning this drive for a refund under my statutory rights. Having all three "refurbished" drives failing within less than six months demonstrates that OCZ's refurbishment procedure is simply inadequate. I don't think anyone would accept that it's reasonable for one drive to fail within 2 months, one to be DOA, and one to fail within 4 months.

    To clarify my position, I'd draw your attention to the The Sale of Goods Act 1979, which makes it an implied term of the contract that goods be as described, fit for purpose and of satisfactory quality. I presume you are not disputing my claim that the goods are unsatisfactory?

    Furthermore, The Unfair Terms in Consumer Contracts Regulations 1999 make it clear that any contract term that attempts to exclude or restrict my statutory rights will be unenforceable. The extremely limited warranty term you refer to has the effect of taking away my right to reject goods that are defective and therefore is unfair and unenforceable.

    I'd like this to be an amicable return, so could you please escalate this on your side - to OCZ if necessary.
