    Car accident....oil spill..

    was involed in an accident this week.

    I was behind a car, well within braking distance and not speeding, the car in front stopped as soon as the amber light showed.

    I breaked but just slid and slid until I hit the car.

    We exchanged details and when I as driving to work the day after I notcied that a large length of road where I skidded was covered in sand.

    I tool photos as soon as I could (two days after) and the some of the sand was still there...and there appeared to be oil evident.

    Can I have any comemts on this incident; that is, can I use this in mitigation??

    You would need proof that the oil was there before you had the accident, perhaps statements from other drivers that had skidded.

    Although why the first car didn't also skid on the oil is rather suspicious.

    I'd reckon your best asking your insurance company, I'd imagine if you can prove it was there before you had the accident AND had been reported they might claim against the roads authority. Its unlikely so your probably just going to have to suck it up and chalk one down for experience.

    Contact the local highways dept they may be able to help but is it possible the oil came from your car?

    Not really. The only wheels the oil would have a chance at getting would be the rear ones, but that wouldn't then make the whole car slide.
