Recover cost of repairs from thirdparty.

Hi everyone, hope you had a better xmas than me.

I am currently facing my car being a write off due to age of car, cost of repair V the value of the car.

I have had the car inspected by my friendly spanner monkey and the only thing that is needed is the bumper replacing, he can find no other sign of damage.

Scrap yard prices is around 30 quid upto 150ish for a 'new' painted one.

I am currently debating withdrawing from claim because of the hit i will take for the next 5 years when they pay out.

I would like to know if there is another way to recover the cost of the replacement part from the thirdparty or is it a lost ca1use ?

If you contact other party and ask them to cover the cost of used part from breakers to avoid insurance process, they might agree if they think they'll get off cheaper than their excess (typically £100 to £250). If they know you're not going to press it due to legal expenses, it might be a game of chicken. Either way - go for the breakers yard option IMO.

If you go through an insurance company, they will probably force you to get it repaired at a 'certified garage'. Trying to get it sorted without dealing with insurace is always cheaper and less hassle, so I would try and push for it.

If you can't come to an amicable agreement with the third party, you can go through the fast track court (used to be the small claims court). It isn't that expensive, and if you win, you can claim the court fee from the other party. If you have photos showing the damage, that helps.

Of course, it is still an accident that you are required to declare at renewal time, although if you win the case it is a no fault accident and will probably be ignored by the insurance company.

No fault accidents still have a tendency to put your premium up for a few years, as statistically you are more likely to be in another accident (according to the insurers)

Specially when you have paid for protected no claims. Time to go think of a happy place before I start to rant
