    Where do I stand??

    Right basically this is about my current job that I've had since nov 2005 (when I was 16), right its basiclly heavy lifting at a supermarket (wont say which one incase its agains the rules) now ever since I started my conract hours were 22.50hrs a week but I've never actually had that many hours its more like 40hr's a week with two days off mainly sunday and friday which is a pain as I can't hardly go out to have a good time as most of my shifts start at 6am.

    Now Im not saying I'm the best employe they'll be a few days a month where I wont turn up as Im either hungover (I know it should'nt happen but I'm 18) or to phisycally tired to do the job as were currently understaffed so we all have to pick up the slack.
    So basically where would I stand if I went in and said that I wanted to work tuesday to friday on a 8am-5pm basis as I would be more obliged to work those hours rather than the hours I-m working at the moment which are all over the place like 12pm-9pm then a 6am-3pm ????

    Erm... based on what I've just read I would say there's not really the slack for management to play with in terms of shuffling hours around.

    If they aren't paying you overtime for your non-contract hours, thats grounds to take them to court for breach of contract surely?

    If you sustain an injury through being overworked as well. I'll presume you weren't told of your new working hours? If not thats kind of wrong too, but I think you should contact the Citizen's Advice Beauru, they'll tell you exactly where you stand.

    It depends on your contract, so for yours, this may well be the case. But there is no requirement to pay an 'overtime' wage after contract hours.

    I don't get overtime at all.

    It's in my contract that overtime will not be paid.

    Most companies have a similar kinda thing. That said, I'm fairly certain that the company cannot force you to work beyond your contracted hours, but from my days of shop work I used to take on any hours that anyone was throwing around.

    If you want to change your hours have a word with the person in charge of HR or even the member of staff who's in charge of the staffing firstly.

    I did this when I worked for a large retailer and it actually worked. They are not all mind-readers and as such they don't know how your feeling

    Now to overtime. Any hours done extra were just totalled up to normal hours and when this passed the 38 hours a week, they then got counted towards overtime. Now add shift allowences for crawling in at 6.30 on a Sunday (it was okay.... the nightclub closed at 6 ) and I had a fair wedge each month to pay for my nightclub excersions on a weekly basis.

    My company pays me overtime, or I can chose to get extra vacation hours gained from the overtime
