    Appealing Gross Misconduct Dismissal

    Hi all,

    Just an update but following my initial suspension pending investigation, I was eventually dismissed for so-called 'bringing the company into disrepute' and 'breach of IT policy'.

    Anyway, on Thurs 24th July I appealed this decision and has a meeting with a director at the firm and member of HR. I was told I would be getting a response in 5 working days, although the company literature says 10 working days. Either way, more than 10 days has elapsed.

    I would be very appreciative if someone could tell me what to do?
    Do I write a letter demanding a response? Clearly my old company are not following procedures by taking this long to reply with a final decision......

    Have you written/spoken anything to your trade union? It might be worth bringing it to their attention and see if they can help in any way...

    No trade union unfortunately. I work in finance....we dont have trade unions. Boooo!!

    Harsh. Do you work for an IB? I am quite new to employment (2 weeks into 1st full time job!), so forgive me for my ignorance, but if you have resigned, why do you care that they have suspended you?

    I worked for a investment fund administrator. They sacked me eventually...harms references, makes you more difficult to employ.
    In fact, due to this, I lost my new job with a very very well known IB as the offer was pending references. Although i did notify them of the incident as i wanted to be upfront about it.

    Have you got receipts of when the stuff was sent etc like sending it recorded?

    also did you get a staff manual?

    Unlucky mate... can't you not get your line manager (who didn't have a problem with the email) to give you a direct reference?

    No SiM, people have to send references via HR now.

    They are litterally just a case of "worked from x till y".

    Its quite funny because the result of this is as soon as you see a CV you meet a mate that evening for beers and get all the dirt.

    Speak to an employment lawyer, If the company has failed to follow the correct procedure in any way then basically there up sh*t creed. Check out the DTI website http://www.direct.gov.uk/en/Employment/index.htm .
    Employment law is a mine field at the moment with the rules changing virtually weekly. If the company has failed any of the rules an employment lawyer will be rubbing his hands, you may not get your job back but may get financial compensation.

    Oh well. I have never actually needed a reference, so I didn't know that.

    And hopefully, I will never need one! I am hoping to stay at my bank for the long run - but in this industry you never know what can happen... I know some people who got fired less than a year after joining the graduate programme!

    you on a graddy scheme?

    its intresting it seams to differ a lot between institutes from what i've seen, GS like to scare the crap outta their graddies, this involves firing a large number of em.

    DBK just don't expect you to do anything whilst giving everyone 10,10 bumps each year

    ML just send you to NY for 6 months to learn how to drink.

    But things are changing a lot at the moment, and i wouldn't rule out jumping ship after 18 months!

    op: if your contracting, talk to your agencys legal team, they should be able to give you some pointers. Failling that a big recruiters like aston carter or huxley will be able to give you pointers too.

    Yeah, i got a staff manual...and it states 10 days. it's been more.

    I sent everything via recorded. The company doesnt tho....so not my fault. They do it via franking machine.

    Yeah, thats what i'm hoping for. Clearly they have failed to follow procedure so just wondering what's my next move should be.

    Should i contact them and ask for the decision on the appeal?

    My agencies are pretty poo...i'll find a employment lawyer somehow.

    Screw the old job.....i handed my resignation already. Just p!ssed off i lost my other job cos of these mofo's. The job was hardcore too.....never mind. Plenty of other jobs out there.

    Yup just joined the analyst grad scheme... I am nearly FSA approved

    I heard that about GS, 1/3 of people get fired and 1/3 of people hate it and leave. So GS have to hire 3x as many people as they forecast they need in the future. (Not sure if this rumour is true)

    I am not ruling it out completely, but if I will try to stay if it doesn't affect my career progression.
