I'm yet to see that established... he could have been a passenger with someone who wasn't drinking that night... until i know for certain i will withhold judgement.

As others have said, the only saving grace in this story is that he didn't take out another car or some pedestrians on the way. Very sad for the passenger & their nearest & dearest, and presumably guttingly guilt-making for anyone close to Ryan Dunn, knowing that he's managed to wipe out both his, and a friend's, life so dramatically...
And just to add, I had no idea before reading this thread and the accompanying links who Ryan Dunn was... I feel soooooo old & out of touch

Want to drink, don't drive. Its not as if he couldn't afford a taxi/hotel. At those speeds with judgement so impared, he is very lucky to have not hit someone else.

Beeb article didn't mention booze, nor do the police as far as I can tell? Was he actually drinking (properly*) or was it just bad luck?
*i.e. not the one with a meal/pub quiz roundup/whatver yanks do or whatever.
The Huffington Post (cited by Oolon above) claims that he had posted a picture of himself drinking with friends earlier in the evening.
The BBC cited by Kalniel reports speed as a likely cause. Neither refers to an authoritative report that he was over the limit. I guess if the body was badly damaged, that may not be determined until the post mortem.
