    Using windows sample music in a video!

    Not sure what section this should go in.



    I have made a video for my site its just a short 35 second one, and I decide to add a track from the windows sample file. Now when I look in youtube it mentions about the copyright, and it is owned by someone else. The track is called 'mr scruff'. Am I allowed to use it? Or is there a way to go about using it legally ?

    The email I had said this :

    Your video "./././././", may have content that is owned or licensed by [Merlin] Ninja Tune Ltd, but it’s still available on YouTube! In some cases, ads may appear next to it.

    Its a copywrited song, you dont have the legal ability to use it really... youd have to email the composer i think?

    mr scruff is the artist (iirc, a DJ); the track's called Kalimba (assuming you're using Win 7 / the sample music hasn't changed!). To use it in your own original work you'd need permission, as with any copyrighted work (I assume MS have paid for a license to distribute it with Windows as part of their sample music). However, it'd be worth googling Mr Scruff Kalimba* to see if it's licensed under any of the Creative Commons licenses - it may be that you'll be able to use it as long as you acknowledge it properly in the video.

    But as a general rule, original compositions - even if they're distributed free of charge in any form - are still copyrighted, and you can't assume that because you got it free you're also free to distribute it yourself or add it to your own works.

    *EDIT: I'm too nice you know - I just did this. As far as I can tell it's not CC'd so you'll technically need to contact the artist or their publishers to get permission to use the song in your own work (I believe - but IANAL).

    Mr Scruff and Xen records have been known to be very kind to people who wish to use any of their works to be creative with other things.

    I'd recommend letting them know about what you've done, even if its just a tweet!

    Is it not OK to just say in the description that the music is owned by Mr. Scruff and you do not own it.

    Not really, as he'd still be copying and distributing the music without permission. It's quite possible he'd get away with it, but the right thing to do is get permission to use the track before distributing it worldwide

    What if you advertised the artist?

    e.g. a Kylie Minogue music video. In comments, you write song is owned by ... erm.. studio X and belongs to Kylie. For her other songs, visit amazon.com\kylie , etc.

    The general rule is that you need explicit permission for a song unless it's released specifically under a licence which allows you to use it.

    Hey I know this post is old but I'm trying to contact Mr. Scruff for the right to use kalimba in a youtube video. Can you PLEASE help me! I tried his facebook a week ago and havent heard back. Any leads would be much appreciated!! I sent a friend invite to you earlier. I was hoping it would let me pm you but I guess this will work. Thanks!
