    Can I claim for damage to phone from TFL?

    Good evening fellow Hexites,

    I'm rather pissed off right now as I had to work overtime and trains were delayed on the way back from home but the thing that topped it off was when I got off the tube (London Underground), they closed the door on me which caused me to drop my brand new OnePlus 3.

    Thankfully the screen didn't shatter but now I have scratches on my screen plus a big fat dent to my brand new phone...

    Obviously I am super pissed at this now and wonder if it's worth my time to try and claim some sort of compensation or whether I should just suck it up and keep my not so new phone now.

    Funny thing is I probably would have been fine if I was jumping on the tube because even if the phone did fall, the surface of the tube floor wouldn't damage my phone. However as I mentioned, I was getting off the tube and it was one of the outdoor stations which meant rock solid concrete ground.

    I've never had the doors close on me whilst I was getting off on a station that wasn't in central London. I can understand that sometimes in central London it gets busy and they run a tight service so doors close on people before they have even managed to get off and people waiting can't actually board (or they try and then chaos ensues) but at a zone 4 station it is usually just people getting off and doors closing when people have all gotten off.

    It sucks being OCD as I liked using my phone naked but now I have to pay the price as it's dented and scratched and really bothers me.

    I think it was a fair question Ulti, but you still aren't going to get any compensation. Proof this happened for a start, and even if you could prove it, you'd jump though so many hoops just to be told no. Don't waste your time, suck it up and move on.

    If you have the time then I suggest sending an email, despite the crappy replies in the post I would have emailed regardless as it costs you nothing.

    Unless you can prove negligence on their part, then .... yeah, probably.

    BUT .... two things.

    1. Sometimes, bitching to the right person gets you a 'goodwill' gesture. In that context, emailing CS gets you nowhere. A polite but irritated letter to their MD/CEO just might work. Stress, might.

    2. Phone insurance? Or, section on domestic contents policy for 'all risk'?

    Just my 2p.

    Yeah, insurance claim was the first thing that came to my mind. That said, as someone who -doesn't- insured his phone.. well

    My sympathy, but the fact that the screen is still intact is a consolation. I have seen many new phones with cracked screens. And yet people still pushing for biiiger phones..

    I reckon a good 20% of my friends - or at least the ones under the age of about 25 - are currently using a phone with a cracked screen; some of the quite severely so.

    I've only ever had a phone screen crack once - and bizarrely it was a sliding feature phone with a tiny screen, and it went not through being dropped or stood on, but by me getting into a car with the phone in my trouser pocket. Sat down, loud "crack". That said, I dropped it into a 3 service centre and had it back fixed within a couple of hours. Now *that's* what I call service

    OTOH, I once sat on a pda (it was in my back pocket) and cracked the screen. Phoned the insurance company as I'd shelled out extra for an all risks policy, only to be told that my all risks cover only applied to accidents *outside* the home, and because I'd been at home when it happened it wouldn't be covered... Always read the small print.

    I've actually never cracked a screen on a -phone- (*). Then again, I hold the minor distinction (yes, I know there is at least one poster on this thread who doesn't have a smartphone at all) of owning only 3 "smart" phones, the first one being pre-iPhone era (Sony Ericsson P800). My 2G iPhone and Galaxy S3 have both seen some pretty mean drops (especially the later when it fell off my shorts onto hard concrete while I was pedalling at speed. It bounced a few times, sending the phone, back case and battery in three directions but when I picked it up and put it back together, I only saw a small dent.

    (*) My iPod Touch 4G wasn't so lucky. It was barely a week old when it fell out of my backpack right onto a rock when I was taking something else out. While still fully functional, it joins the the many beautifully cracked screen devices Fortunately I picked it up cheaply after the 5G had been out for a while, and it was used mainly as a music player and for those iOS apps I missed after moving to Android.

    I do sympathise, the first scratch on anything new, be it, phone, car, watch etc is intensely irritating at the time, but time does help put it into perspective...

    And it could have been worse, falling onto the track bed, for example.

    As for claiming, other than the circumstances Saracen mentioned, I'd think you stand little chance. They might ask why you were holding the phone in the first place while getting off the train.

    But I do feel your pain.

    This is why the phone case industry is massive.
    Personally, my fancy, funky über-fancy phone is in an Otterbox Defender - Highly recommended!
