    returning items in clothes stores ???

    last week i was on another spending spree in the shops and in one shop in particular i bought a t shirt and switched it
    then on the way out i seen they had lots of diesal trainers on sale i saw a pair that i liked and they had a sticker on them saying reduced im sure it said around 55 or 65

    so the guy went round the back for 5 mins and came back saying i got the last pair tried them they fitted and went and paid for them but never checked the price

    checking my receipt when i got home it says 95 quid , which would be fair enough if the sale sticker said that but it never and for another 20 quid i could have just bought timberland boots which resist alcohol an pi ss more than my other diesel trainers !

    im sure he muttered something about not doing a cash refund in the shop but i wasnt too fussed as i had just bought a pair of trainers at a decent price

    is he takeing the pi ss ?

    and dont we have rights to get a cash refund as i havent worn them yet ?

    i think they may try and palm me off with store vouchers but its rare that they have stuff i like
    and i wouldnt have paid 95 quid for trainers just to mess about in !

    is it true he doesnt have to give me my money back

    not a legal expert by any means, but IIRC by giving the money for goods you agree to a contract by which you will give the company £xx and they will give you the products. Also on your receipt (normally the back) you'll find the company's terms and conditions of sale. It'll be here it states what kind of return policy they have. It all depends on what it says on there as to what you've agreed to, and whether you'll get cash back or store credit - or even nothing at all.

    If you've already had one refund, and you're after another i think you'll be pretty lucky if you do get some cash out of it. How legal that is, iunno :shrugs:

    nope. if its with in reasonable time (few days or so) and as you originally bought it, and you still have receipt then you can get a refund. and don't get fobbed off with store credit...its worthless cause in essence they still have your money.
    if they dont give a refund then get hold of trading standards etc...

    atleast i have some encouragement then , in the last year alone ive spent hundreds upon hundreds in that shop and the guy knows me so he should out of good will fair enough if there is something else in the shop i like i will buy it fair is fair but if he comes out and says theres no chance of a cash refund then i think i will contact tradeing standards

    not so much of the cost of the item but the fact i bought it thinking it was on sale and he disappears round the back for 5
    not for definate but i think the price may have got bumped up as it was his last pair of that style and he saw how easy i was with my switch cars minutes earlier

    You have a right to demand a refund if there are either grounds to return products under the Sale of Goods Act (as amended), or if the store operates a grace period policy (like Argos). But, to get that right under the Sale of Goods Act there actually has to be a problem with the goods, either in that they are defective or that they are not fit for the purpose.

    If you just change your mind, you do not have a right to demand a refund.

    Despite that, many shops will still give you a refund on goods just bought that have not been worn, but it is a matter of goodwill, not legislation. By call means check this with Citizens Advice, or with Trading Standards, but I'd advice against using that threat in a shop where you want a refund because you just changed your mind. They are all too likely to tell you to go ahead and call Trading Standards.

    i thought (but could be wrong) that if you havent worn them and return them in full packaging within 7 days u can demand a full refund

    Saracen is right that you can't just demand a refund because you changed your mind. However, if the price on the item was less than £95 they are breaking the law charging you that much for them. Take them back and politely explain that there's been a mistake. They'll more than likely apologise and give you a refund. If politeness gets you nowhere you could tell them that you're going to Trading Standards- overcharging is something that they take pretty seriously. I'm sure it won't come to that though.

    Nope.
    Infact a store doesnt have to give you a refund for upto 14 days even if the product is faulty. This is how much time they have to find a suitable, or "like for like" replacment for you. If they cant supply one within 14 days, then they have to offer a refund.
    Companys that offer you a refund because you dont like them, or you have changed your mind are doing it as goodwill / customer service. Thats why it pays to be polite about it. If you want to be arsey with them, they can simply say "no refund", and there is jack you can do about it.

    The exception is the cooling off period, but that only counts with mail order, ect..

    Exactly as everyone has said - you can take the goods back to the shop but the company doesnt *have* to give you a refund. However, they do have to let you exchange or give you credit notes for the value of your original purchase.
    Having said this the only way they can deny giving you a full cash refund is if their returns policy is clearly posted in the store. Its not good enough just to have it on the back of a receipt, it MUST be clearly displayed in the store so that customers have the opportunity to see it before they purchase anything.

    tbh if you are polite when you go into the store you shouldnt have a problem. Returns policy is usually 28 days.

    Out of interest which store was it??

    it was retro in east kilbride near glasgow for people who dont know our area

    i think they are more an independant shop with 2 shops either end of a very big shopping centre , i dont want to have to go in there and if the guy doesnt cooperate have to start threatening tradeing standards and trying to reason with him as he is clearly takeing the proverbial

    i cant even remember seeing a pair of diesel trainers that expensive up here i have had 4 pairs not includeing the ones i just bought and the most expensive ones were 75 quid
    but that price was clearly stated and not on sale so i have no problem with that ,

    i was actually looking to get a new pair of timberlands as the bad weather is going away an they dont get knackered so quickly with the muck and rain i would have preferred to spend the extra 20 or 25 quid to get them than a pair of light almost disposable trainers at almost a 100 quid

    oh im past the 7 day thing someone mentioned as it was last thursday night , my own fault but i only noticed because it because i was checking my account statement online as i do every week or so

    Sorry, but thats entirely wrong. A store does not have to offer you a exchange for credit notes. If they do this, its out of their own will.

    Believe it or not, but its up to you to find out what the stores terms and conditions are before you buy, further more, as ive pointed out, a shop is not obliged to give you a refund simply because you don’t like the product.
    If it’s sold unlawfully though (such as being sold unfit for the intended purpose), then you are entitled to a refund. Wear and tear is also general not covered, although many items have a limited warranty by law (for example, nearly all electronic devices are covered by a year as standard).

    I bought a pair of basketball trainers and after 2 days the sole came away....footlocker replaced them and after 3 months of HEAVY use the sole began to come away again....so I cheekily tried to take em back again expecting nothing and it worked

    Just be nice and most places give you refunds unless its ridiculous
