    What can I do?

    Hey guys,

    Here's the deal. Currently im with Aquiss Internet. Now at christmas they charged me £10 too much out of my account without authorisation from me. I asked them to sort it out and refund me (because my account went overdrawn i had to pay the alliance and lecester an overdraft charge of £50). I only asked for the £10 as i dont think they would pay the extra charge they made me incurr. Well its now the middle of february and still no refund.

    I told them 1 week ago,yesterday and today that i wont be paying this months bill until i get refunded. Now i know its only a tenner but at the end of the day its my tenner and ive already had to pay £50 worth of charges because of them so really it is £60!


    Now they arent answering my emails etc and are just basically ignoring me. If i dont pay my bill, my adsl line gets cut and i will have to pay an activation fee of £40 to enable my line again.

    Is there anything i can do to get the £10 back and is there anyway to claim back the £50 they also cost me due to me only having £40 in my a/c for the bill but them charging me the extra £10?

    Sorry for the long winded post and i appreciate any replys you guys have.

    Really sorry to do this, but I have just noticed - your sig is quite massive.

    Perhaps not all of it is really needed?

    Hope you get your money back mate. Barclays only steal £30 from my account whenever I go overdrawn... £50 is taking the piss.

    Nice how the banks take money from your account when they know you haven't got any money as you've just gone overdrawn.

    Did they give you notice they were going to charge you? The few times Barclays have tried to charge me I've called them up and complained that I was given no notice of the charge (they used to give you at least 14 days notice)... I've been refunded every time (about 4 or 5 times so far). I think the banking code has changed as I'm pretty sure they had to give you 14 days noticed of any charge at one point. Now the code says:

    Talk to trading standards if you havnt had any replies back, jus make sure you take print outs of all the emails u sent to them and the bill, plus where A&L charged you £50 for overdrawing over the limit?

    Theres a way to claim back all bank charges, through the small claims court, was on the BBC website a while back

    small claims court costs you 40 squids to file the claim.
    dont not pay the bill, otherwise you might get black-listed.
    unauthorised overdraft charges have been reduced to a maximum of 12 pounds at a time i think

    claim your bank charges back from the alliance & leicester - they're only allowed to charge you £12 for going over your limit - any more and they're doing it illegally.

    Nope. They send me a letter telling me they have charged me, but nothing prior.

    hmmm same here...halifax charged me £30 a few weeks ago for going overdrawn on my current account. No prior notice, just a letter saying I owe them £30.

    errrr, you can totally claim those back, look at the Consumer Action Group forum for more info, I am doing Barclaycard at the moment and I already got £75 back from Barclays. I got that back by simply complaining about it. This time I am doing it properly.

    Neon, if I were you I would ask for my MAC and move on, its only £10 and recovering it if they won't respond to a complaint is gonna cost more so I would say either complain more or move on.

    hmmm think i got charged around £30 cause i went overdrawn, thing is, im not even its legal for them to let me go over the limit as im only 17?...and the account is only a basic Natwest one with a solo card...

    Im sure in this case your within your right to call it fraud and talk to your bank and let them fix it. IMO thats the best thing to do if the bank also want overdraft charges.

    Im 17 and never happens to be although its always like £1-2 overdrawn

    If their overcharge caused your bank account to incur bank charges and you can prove it (via a bank statement for example) then you can claim the overcharge and the bank charges.

    You need to get an acknolwedgement in writing that you have been overcharged before you can really get very far with this.

    ISPA is the self-regulation organisation for ISPs. If you make a complaint through ISPA then your ISP is duty-bound to investigate and respond to that complaint within a certain timeframe.

    I've made a couple of complaints against ISPs through ISPA before and on both occasions, the complaints were resolved very quickly.

    Anyone need help on suing banks, I've done it 3 times so far, and won over £2000.

    I wrote a how to article and sent it to David, before the whole thing blew up in the media and every man and dog started it.

    It's simple and the only things it requires are patience and £30 for court - which you get back when you win.
