    If its a handset held within a "group" of mobiles on a company account, I'd like to see it proven which phone they were using. Unless the officer pulls them over, photographs them using the phone, and then photographs the IMEI sticker on the phone there no way of proving anything - who is to say you weren't simply scratching your head, or supporting your head with your hand?

    Its a load of loophole filled rubbish, I really do feel this law will be actively enforced for a month, then forgotten like the last one was.

    CPS isn't going to waste its valuable already overstretched resources getting mobile phone bills from the networks for the users, getting them to tri-coordinate the signal from the call to prove it was that mobile in that location then have to prove it wasn't the passnger, just to give someone 3 points.

    Its just like the prove it was me speeding, I can't remember whether it was me or my mum and the photo doesn't show it. They'll probably just unlawfully give drivers points and fine s like they have been doing for years.

    Innocent until proven guilty, unless you're a driver, then you're just guilty guilty guilty.

    so does this mean the police and taxi drivers can get fined and get points when they talk on thier radios in their cars. i doubt it.

    If the police start actually enforcing it then good but they dont seem to care.

    My main beef with this is that the majority of people who talk on their phone whilst driving who i notice drive big expensive cars. I dont understand how they cant afford the 10 quid for a handsfree kit after spending 20 +K on acar

    Because the factory fitted car kit in the car is terrible (they generally don't work with more than one manufacturers phones) and they don't want to void the warranty on the shiny new motor by hard wiring in a kit that actually works with their phones.
    Ask anyone thats got a BlackBerry - its as if car kit manufacturers think that they don't think they talk while driving - only one manufacturer of car kits supports them properly, and thats Parrot.
