Why, because you don't think the law should be upheld as written?

The UK court simply ruled that the Samsung design is sufficiently different from the regsitered Apple one to not legally infringe on it. And that's all the court has jurisdication to rule on: whether Samsung has acted legally. Which in this case they have.

And if we're talking about innovative design, I have one thing to say. TC1100. A rectangle with round corners and a touch screen is *not* a new idea.

I guess that I was not clear enough: I meant whether there are precedents where a plaintiff, who has lost the case, needs to make statements on their websites and magazines retracting the accusations. We have seen a lot of IP related lawsuits in the past, but I don't quite recall one where this has happened.

(Barrack room lawyer mode on) I was under the impression that Samsung argued (successfully it would appear) that Apple's loud claims that they (Samsung) had slavishly copied Apple's designs were defamatory when Apple's claims were dismissed - because those claims were well reported in the media. So Apple needed to either pay damages or do something to correct the slight to Samsung's reputation. And in this case the judges decided that the "do something" was more appropriate in this case.

The fact that us folks with little respect for Apple's legal bullying also find this punishment funny is just gravy...

Also interesting (to me) is that the oft-quoted "examples" from the US where someone went into to buy an iPad but came out with a Galaxy Tab by mistake were never brought up. Then again, maybe the judges agree with the comment I saw on those incidents that "someone dumb enough to mistake one for the other shouldn't have been allowed to buy either and, personally speaking, should not have been allowed anything sharper than a wax crayon!"

One thing that I hope comes from this case, is that Samsung perhaps try a little harder in the design department. Apart from the Galaxy Note 10.1 (which I REALLY like) I don't really see any particularly noteworthy design/innovations in Samsung's tablet lines. Perhaps that's why Google chose Asus to do the Nexus tablet?
