It could be done like that intentionally to allow traffic shaping of P2P or other technologies that have an adverse affect on network performance while still imposing restrictions on ISPs soliciting lucrative deals from video streaming companies. It is more difficult to block competing streaming services, or to prioritise one streaming service over another, when you are not allowed to discriminate by source effectively preventing the deals that are being done in America where Netflix is subsidising the already lucrative cable companies to ensure their service gets the required bandwidth. It might not give us an unshaped internet but it prevents the internet getting prioritised based on bank balance.
