The problem with O2/BE that i have noticed is that they oversubscribe, so you are throttled purely by contention
BE over subscribe? Where are you reading about that too? I have never seen a slow down (and I am a very heavy user) and their upgrade program seems to be constantly adding capacity.
It's the reason they are not part of the current FTTC system. They have struck a deal with BT to be outside of the usual contracts so that BE users can continue to use their connections how they want and at maximum performance. Trawling their forums you won't find anyone with performance issues unless it's down to the sync speed of their line......and their blog post on the fibre issue pretty much sums up their mindset.
The FUP is basically saying: Don't spam, don't hack, don't be a nuisance.

nope im still on the old contract. I either get throttled or the contention is bad for me. I spent ages on the phone to them trying to get to the bottom of it and got nowhere.
Maybe you dont, maybe your area is different to mine but i dont get full bandwidth downloads at all times of the day... and its not related to the host either before you suggest it.
There are certainly congested exchanges on the Be network, as you say I'm in a different area, i.e. on a different exchange and not subject to the same level of congestion.
If you haven't already, you can run ping tests like the ones at f8lure for a better idea of how your connection performs over time.

Contention is always going to be a potential issue on any type of broadband. Example: I used to have a 3 wireless broadband dongle. Living near Salford Quays, I never got better than ~ 50KB/s download (~ 512Kbps link), and usually a lot less than that, due to network contention. When we moved to Longsight, we rarely got less than ~400KB/s download (~ 3.6Mb/s link), purely because of the much lower contention out here. The link speeds reported by the dongle were always the same, either 3.6Mbps or 7.2Mbps.
However, it does sound like the OP's problem is not contention based, but FUP. I think the easiest solution would be to get rid of this particular set of lodgers ASAP, tbh...
