Does it matter? Legally, Scan have to replace it/partially refund if it fails outside warranty for up to 6 years.

It applies to all goods but it's not necessarily 6 years. For example, for perishable goods such as flowers it could be a few days. On the other hand, there's no reason why a hard drive couldn't last 6 years or more, especially if it's on the expensive side.
It's civil law of course, which basically means a retailer can completely ignore it if they so choose, and in this case the only thing you can do is take them to court.
How about a response from Scan as to whether it is a mistake or not as it will affect which one I buy

Having looked into the warranty status on these drives I can confirm that the warranty should be advertised as 12 months, the website has now been amended accordingly.
However after checking 10 drive serial numbers at random, they were all covered by WD until February 17 2015 so in affect the drives I have checked carry a two year warranty.
I cannot guarantee that all of the drives we stock will have this warranty period as we source our drives from different suppliers.

Just to complete the story
In the end I bought a 500GB Caviar Green which is said to have a 2 year warranty.
Ordered 14 Feb at 10.39
Order made and Payment authorised at 10.45
Picked at 12.30
Despatched at 12.34
Delivery supposed to be between 16.12 and 17.12 on 15th Feb
Courier arrived at 16.12 as he was waiting up the road for the delivery window to open
Checked warranty with WD (after spending 5 minutes getting the hard drive out of the bubble wrap and wondering was was loose inside - desiccant crystal packet) and it is valid until Oct 2015 so actual warranty 2 years 8 months

If you register your WD HDD with WD they give you an extended 5 year warranty, unless that is it's as one off Amazon I bought that turned out had been sold into Ghana and sold back to some unfortunate (me) here in the UK, in the end I bought all my Caviar Blacks from the WD Store, first time I've found buying direct was cheaper than anywhere else.
