hi ok i have looked at event viewer and there are some warnings and red markers, are these a potential threat? can they be removed or do i need to do a clean install?
also its a vista upgrade do i only use the win 7 disk or both vista and win7?

start>run and type "eventvwr" without the quotes, then press enter. Have a look for errors in the system and application logs.

What sort of things are the errors and warnings stating? They may or may not be related to your issues, and without more info we're going to struggle to help. Any error codes?

http://support.microsoft.com/kb/950375 will sort that particular error, but I somehow doubt that it's the cause of your issue.
if i do a clean install will that cure it?
there are quite a few different error msgs!
will i need the win 7 disk only?

It *might*, but there's no guarantee. If you have your data backed up and have the time to invest in a clean install then I guess there's nothing to lose. this explains how to do a clean install from the upgrade media, but as always be sure you backup any data that you need to keep before you start.
