    Appeal deemed inadmissible. The amended results stand.

    The competitor Vodafone McLaren Mercedes appealed the Steward’s decision before the International Court of Appeal in a hearing in Paris on September 22nd.

    Having heard the explanations of the parties the Court has concluded that the appeal is inadmissible.
    Paragraph 5 of Article 152 of the International Sporting Code provides as follows:

    Penalties of driving through or stopping in pit lanes together with certain penalties specified in FIA Championship regulations where this is expressly stated, are not susceptible to appeal.

    Just confirms what a lot of people think. F1 is not a sport. Sports have fair and impartial rules that are applied impartially. F1 is just about money and politics.

    And football never has biased, or blind, refs. About the only "fair" sport is rugby where decisions can be overturned.

    F1 is marred by controversy....conversely, it may not have reached popular heights if it wasn't. Nobody seems to want to discuss racing anyway unless something controversial happens.

    What I can't understand, is why Ferrari were representing in the "courtroom".

    McClaren vs FIA, surely?

    I didn't see BMW Sauber there.

    Ferrari never appealed the result or manoeuvre immediately after the race (unless they had a "quiet word" somewhere instead).

    Grrr. They spoiled the best race of the season, for many a season actually.

    Well, yes you're stating the obvious fact there. But my point is, the issue was between McClaren and the governing body, not McClaren and Ferrari. Ferrari didn't dish out the punishment that McClaren disagreed with. Dont' forget, as I pointed out BWM Sauber gained an extra place here for 2nd too. Ferrari are bound to argue one way as it is to their advantage, but they will argue their point whether right or wrong. Surely it should be done independently of anyone that has a vested interest?

    Ferrari had no gripes with this manoeuvre at all during or immediately after the race, until the stewards decided to get in on the act, then they smelled a way into a "win".

    That clip above illustrates perfectly the inconsistency and incompetence of the FIA.

    Shame they did this. If Massa wins, it'll take the shine off it for me.

    So why were Ferrari's team ("prosecuting") cross examining Hamilton, and not merely being cross examined themselves as witnesses?

    Isn't it true anyway, that they never heard the actual appeal on the penalty in the end, as it was deemed that you cannot appeal these penalties, which is at least a rule written down in black and white. That in itself I guess, is fair enough.

    No, the appeal was heard, as it was in the same session. The deliberation overnight was on 2 counts.

    Can't answer the first. I don't know. Haven't read the proceedings. Are the available somewhere?
