    Quick Legal Question - Illness at work.

    If you're ill at work, what is your position on going home (don't worry I'm not ill). Someone I know is, and she's scared the boss won't let her leave, or will punish her for it. I've told her he can't, but to be fair, I don't actually know. Anyone know?

    Would the boss not let her stay at home as well?

    She should just sign out, go home, then ring the boss from home saying she's ill.

    I don't think you can be punished for being ill, if you're ill and unable to fulfill your duties, what's the point in being there in the first place?

    I'll be honest, my concern is quite selfish, I'm a singer, she's coughing and spluttering everywhere - it can't be good, and I don't need another illness - just got over a cold!

    AFAIK, you can self certify for 7 days and the law makes no provision for deciding to do this in the middle of the working day.

    As long as she isn't contracted too provide a service, which she won't get done in time by been ill, and lacks a clause. I've never heard of anyone been in trouble for taking 3 days off.

    In my contract i'm ment to then get a doctor's note.

    Ive had this before, i was ill at work and wanted to go home so i said to my boss im feeling bad and wanna go home but he said well you might as well work the rest of the day but i disagreed and said well im going home anway cause i feel horrid regardless of what he thinks and just signed out and went home and got the doc round which he phoned my boss and sorted everything out and explained that i was ill etc etc.

    So its perfectly ok for her to go home if shes feeling ill, even if your boss says otherwise your health comes first before anything else, just make sure she goes to the doctors so she then has evidence that she is infact ill.

    It can be in the company's own interest to send people who are sick home, as it will reduce the likeliness of it spreading. When I used to work for a small telecom firm (6-7 people), I went in work feeling quite poorly (I like to keep busy to take my mind of my illness ) and the boss told me to go home and if I ever feel ill again don't come in as it could take down half the company!

    So unless your boss wants to possibly deal with several people going sick at one time, he should let her go home.
