    Clamping LAW

    Does anyone know anything about clamping laws in the UK?

    Me being a tard parked in a space which is marked as youll be clamped.

    Anyway the people who do it came round, I saw them, jumped into my car started the engine and was moving (though) just a little. But he stuck the
    sticker on and took a photo.

    they are a private company and they were changing the signs that day.
    When i parked the old sign was up and when they got me the sign had been changed.

    It seems the fine is for the new prices and i was charged that.

    Also the sign only talks about the price of having the clamp removed and things related not how much for just parking their. What is the law on this.

    Im going to pay as if i pay under 7 days its 50 instead of 80.

    By the way its no a council issued fine as in a PCN but i cant find any info on anything.

    Have they got a pic of you in the car?. If they have i'd say you could argue it and simply say you where unsure of your way and merely checking a map etc, and wasn't stopping at all?.

    Stunned that the guy was trying to attach a sticker to a moving vehicle etc...

    I'd certainly try to get it invalidated myself

    I should be in the picture, I had just started to move when he stuck it on. and had to drive slowly as they had put their van in front of my car. I had parked there and they
    knew i was around. Stupidly i listened to my brother and didnt move the car when i saw the signs being changed.

    I can only find info on council tickets... im not sure what the law is on not being clamped. Also like i said before the fine isnt indicated on the sign as such just clamping removal fee.

    To be fair if it's a private firm I'd ignore it, and go with the checking the map excuse.

    If I was you, ignore it. If they persue you, say you parked there, saw the sign, and as you were moving off they had blocked you in and proceeded to take a photo of you in the car. Also, find out if they're licensed clampers, don't forget a new law has just been brought in that makes it illegal for clampers to operate unless they're licensed.

    Wright them a letter in a law style. Sounding like you mean business, pointing out that the car was moving, and they targeted you, and you have 6 kids, and your in a weelchair, and your whole family (apart from your kids) got killed in a plane crash. And you best frends bill gates's lawer.

    surely they can only charge a fee if they actually clamp the car ?

    Can't see how they can charge you an unclamping fee if you weren't clamped tbh

    Well the whole point in clamps is that people need to remove it to use there car... they probably wont chase up the fine as they expect people want to use there cars...

    I would write them a letter threatening legal action (for improper clamping of moving vehicles?) if they refuse to pay your £7000 in damages from sticker'ing your car.

    They're only interested in easy money. At most they'll send a few threatening letters. They won't take you to court. What law says you are obliged to pay them? If they write, reply & ask them, politely. They won't answer, they'll just send yet another demand.

    Do you always give money to people who demand it?

    The "pay £50 now and not £80 in xyz days" is a ploy to make you pay up. To make you think "well i don't want to pay £80 so I better pay £50 now!"

    Ignore it, they can't do anything. You weren't clamped so there's no unclamping fee to pay. They have a photo of you in the car whilst moving. You can use that to your advantage, all you have to do is come up with an excuse as to why you stopped there;

    you pulled over, then saw the sign, but they blocked you in and tried to clamp you.

    you pulled over because you thought there was something wrong with the car

    you pulled over and then realised you had the wrong address

    etc, etc, etc. Just choose a story that suits you best, and make it out like they victimised you. Assuming of course they actually persue you for anything, which I dount they will.

    "Yes your honor, you see, we were going to clamp him but he moved... but we still want our clamping removal fee!!!"

    Can't see that going very far can you?

    The problem is what the law really is, i cant find anything about it. Also I wonder if it could affect my credit limit in someway which is worth more than £50.

    Also im not the one who is going to pay my brother is seeing as i went to his place to help him and he said my car would be ok even though we saw them changing signs.

    I think a fair bit will be down to what was on the signs before and after, what judge would agree that replacing a sign, then doing you under the new scheme was fair? The could make a serious amount of cash putting up 'park here free' signs in the morning, then swapping them to 'pay us £50 to be unclamped" signs at midday... hmmm, what a great idea.

    personally if anyone clamps my car, (not that i'll ever park anywhere stupid enough to be legit clamped) its coming off with bolt cutters and disappearing... erm, what clamp gov? must have been stolen. may even get a few quid for it on ebay
