HSBC have changed their T&C now. The terms are very similar but it is worded very differently.
Instead of charging you for them sending a letter, they are now charging for arranging an overdraft, or something. I doubt you could claim back any of the new fines.
Old claims might still work but you wont be getting anything back from new charges. Other banks are probably going to send letters out very soon.
Yup, I got that through about my HSBC account.
However, wouldn't it still fall foul of the legislation - as they are charging for something that costs them a lot less to provide?
Yep, thats what all the fuss is about, banks can not proove that their charges are justified and a figure of £12 is more reasonable to charge customers. Thats why they won't let it go to court cos they will always loose, because they can't justify there charges.
My last bank i did it with, the coop bank. I have never been in a bank that charged so much! For missing a direct debit, which i might add was missed cos coop took the money that was in there for another charge. They charged me £25 commisson, then £25 daily fee, then a further £75 all for the same thing. Then because they took my money for their fee to make me miss my next direct debit, they charged me another £25, £25,£75 AGAIN, Total of over 10 days and all their fee's came to over £300, at the time i was a single mum on benefits as i had just left uni. I went mad at them and got over half back and asked them to close my account. I am now with alliance and leister, they seem to have fairer charges than coop. However coop are now chasing me for charges when i left them, of which i asked them to close my account. So another battle with them i have.
I have always said this and told coop on the phone, when their system was down and i couldn't get access to my money, can i send them a letter and charge them *My* default charges for not having access to my money and then charge a daily fee? No? Yep they said i had no rights to do that.
It will get to the point where we won't have free banking anymore, but if it went that way, i still think we will be better off than paying all these bank charges.

well dome m8 sounds like it was a lot of hassle though- still worth it for £1000- those money grabbing scoundrels (these new hexus rules are drastically improving my vocabulary )

The only sensible thing, paying off my overdraft and shutting the account down.
Best thing is to catch the charges early and claim each one individually. I recently had my first charge (£38 for a failed standing order) and a simple letter to my local branch got me a full refund
You're wrong there mate, a bank has a limited (normally 2) "Good will" gestures which they give. After that you'll get the:
"As I see we've refunded charges before, we can't do it again, sorry."
