Talking Silly question but here goes.....

    I have just received my "new" ASUS P5K this morning from a rather well known e-tailer who has there own thread under Care@Hexus. My questions are;

Do ASUS still seal the motherboard box?
Do they still seal the anti-static bag for the motherboard.

The reason I ask is that my motherboard was open, no seals at all. Parts missing, fingerprints on the board. Ripped bags, bent dog-eared manual and quickguide.

Last but not least it had a FOXCONN PnP cap over the CPU socket to protect it!

Any views\comments are much appreciated, just want to get my facts straight before I rip right into them!

    S.

I got a board from scan which had obviously been opened up and used in some way. The socket even
    had thermal compound on it.

No , you should get the product in a sealed static bag and a box (some are not sealed) but there should be no fingerprints on the board and the manual should be in 'pristine' condition . looks like you have got someones return.

Ps . don't 'rip into them -that achieves nothing , just explain the situation and i'm sure you will get a replacement sent out right away .

Was it that obvious, with quotes like "I can confirm that the board was received from our suppliers on the 27th of July and then dispatched to you on the 31st, in that time it has not been passed to any other customers" and the best one yet "Foxconn manufacture 90% of the motherboards made today" ASUS forums loved that one.

Lets just say the trust is gone, however I will be sending a polite email stating the Sale of Goods Act to them requesting the board be uplifted and replaced with a new one, sealed of course!

    Thanks for all your comments

Can I just ask what makes you think it was this etailer that did it? How do you know it didn't arrive from the manufacturer like that, perhaps them (accidentally) placing a refurbished board among their new ones?

Bear in mind, a retailer doesn't necessarily get any products direct from the maunafacturer, of course in some cases they might, but on the whole they are obtained from distributors.

Don't assume that some one has done it on purpose to you. It may have happened before the retailer got hold of it and the sales process is very quick, sometimes shipping out the same day they recieve the goods.

quoteing sales of goods act doesn't do you any favours either.

just email them and politely ask they replce the product, speak to others how you would like to be spoken to etc etc.
Please do not message me about Scan Free shipping, I no longer work for HEXUS.net

Already have and that is why they are getting the Sale of Goods Act quoted to them.

I was actually given two options "have the items that are missing sent out to you ASAP" and "you can return the board to ourselves and we can issue a replacement for the item"

Now this flings up further questions, where are they getting the missing items from? As far as I know the Q-connector kit can't be bought seperately.

Even though this is not my fault they want me to return the board! It is there legal obligation to uplift the "new"\dodgy motherboard.

If it's not your fault that you have to return something to a retailer or manufacturer then you are within your rights to request for them to refund the postage costs you incur. However, if they find nothing wrong with it then they won't give you that refund.

I've done this successfully with several RMAs to Ebuyer, but they don't advertise it. As per usual: if you don't ask, you won't get.
If you can't keep up, stick with reality...

if this is from a well-known etailer who has a forum in the care@hexus, wouldn't it be better posting it there?
