In theory, yes, shouldn't be a problem at all. There are, of course, certain caveats but without more details it's hard to be more specific.
As to the how, if you could post the model number of your laptop we might be able to point you to a guide.
On most laptops there's a screw on the underside that releases the hard drive cage/cover. Then it's a simple case of disconnecting the old drive and connecting the new one.
You may also want to transfer your data across but that's another question
Sony's and upgrades don't go together at all well. Generally you will find that you have to take the whole damn thing apart to do it.
If like mine yours has melted a little inside.. it becomes even worse.
Just want to add, then there is also the simple matter of knwoing if the hard disk in question is an IDE or SATA interface, if its only a 40GB drive I would assume it is an older IDE drive.
Swapping-out the hard drive is usually one of the easiest to perform end-user laptop upgrades.
I'm (somewhat) surprised even Sony would make it unnecessarily difficult to do, when it's commonly a simple matter of undoing a couple of screws from a hard drive bay
And if they do... even on newer models...
