    Ebay Sale 6 months ago

    Apologies if I have this in the wrong section..

    I sold a Gigabyte GA-H55M-UD2H last August on ebay when i changed over to my mini itx gigabyte setup.

    The buyer never placed any feedback & as a consequence I never left any for him.

    Tonight I get an email saying that he has finally got round to fitting it & it doesn't work due to a missing pin on the socket of the motherboard.

    He states that he hopes I can 'provide an amicable solution'

    My gut reaction is that he has damaged it himself or inserted the cpu the wrong way round, however, i didn't say this. I suggested that he try Gigabyte directly as it was bought last Jan from Scan so would be out of supplier warranty anyway.

    I have sold stuff here, ebay & elsewhere. I am honest & willing to help folk out when I can but personally i smell a rat with this.

    What do you think?

    Thanks for that, i got a reply from him saying that he hoped I will 'do the right thing' but my gut feeling is he's just trying it on.

    Just explain it worked fine when yousold it and had he of installed it with in a week of receiving it and then found a problem it would be fixable, but now it's out of warranty there is nothing you can do and he should of tested it sooner.

    I certainly wouldn't tell him it's out of warranty, as assuming Alistair is a private seller, it was never in warranty in the first place.

    As for the notion of buying something, second-hand, on eBay and then spending 6 months before deciding it's got a fault, well, he's got to be having a laff, hasn't he? "Amicable" .... my nether region. Cheeky chancer is more like it.

    Suppose you sell a car and someone comes back 6 months later complaining the tyres are work out? Do they get a refund? Or even if the engine has died? Do they hell.

    With a private sale and the vast majority of items, the seller is responsible for the item being "as described" and not misrepresented, and that the seller has a legal right to sell it, and not much else. Caveat emptor.

    I agree with all the above.

    Here's my story, got a cpu and mobo combo of ebay a few years back, didn't really need it but it was a bargin so kept it around in case i needed it. Just so happens 2 months down the line I needed it. Installed booted up fine, thats when I found that the cpu was a different model.

    There was nothing I could do, being 2 months down the line. Couldn't really complain as who would believe me.

    So to the guy who want you to do the right thing, bad luck should have check when he got it like I should have done.

    Thats an interesting situation you have there. The fact that the buyer hadn't bothered leaving feedback certainly seems odd especially since he is taking issue to it after so long. I do think however you did the right think by asking him to take it up manufacturer.

    Heres a question though, how does reseller warranty get transferred over? Supposing I buy from an etailer and decide to sell on ebay whilst the 12/24 month RTB is in effect, how doe does the prospective buyer get the warranty carried over? Surely can't send away invoice - a lot of confidential info...

    Same thing happened to me with a USB mixer I sold on ebay. Buyer never left me any feed back, and I never left him any either.

    Fast forward to 6 months after I sold it and a I get a message saying it's now dead and can they have a refund. I kindly said no, sorry I'm a private seller not a dealer. They then sent me a message back stating that the mixer was not of satisfactory quality under the implied terms of the sale of goods act.

    I went back with well yes if you bought it from a trader, but as I'm not the only implied terms they had under their rights of the SGA was that it was as described, and mine to sell. Oddly enough they never bothered me again.

    If I was the op I'd politley say sorry there nothing you can do this long after the contract has concluded, apologise about the fact it's now dead and carry on about your business.

    Sent a message to him last night, politely saying that if he had contacted me sooner i would have been able & willing to look into it. Referred him back to manufacturer again, not heard anything.

    Couple of yrs back i sold a gfx card on that was practically new. It was fine for a couple of weeks then died. So buyer asked for my help. I raised an rma & iirc said i now lived at buyers address, so replacement went there - was happy to help out

    I sold a CPU on ebay about 2 years ago for approx £10, The buyer contacted me and asked if I could send it the same day as his CPU was dead and he needed a replacement in a hurry.

    I sent it that afternoon first class post, To receive an email the next afternoon saying he wanted a full refund or was going to leave me negative feedback as I had sold him a dead CPU which he claimed I knew was faulty. Then after several emails and me requesting the CPU back so I could check it was the same one I sent, He changed his story to the CPU is of poor performance and then went on to say that it met the benchmark figures for that CPU.

    They are just chancers but, I sent him a refund because I couldn't be bothered for the sake of £10. I wished I'd left in it the motherboard and just sold it as a bundle.

    Just make sure he doesnt try to reverse it or something thru them as they'll just take the money from your account, not sure if they still do after that amount of time though...
