    Scan systems are exempt from DSR rejection rights!

    I cancelled my 3xs system this morning via their website and the letter will be hitting their doorstep in the morning. They still delivered it to a neighbour at 4PM today without ever contacting me.

    I've told them I don't accept the PC and they can collect from my neighbour.

    I got an email with this extraordinary claim in it

    Hard drives are configured & Operating systems and software is installed and personally activated before despatch to each purchaser, as such, all systems offered for sale by Scan Computers are personalised and are exempt from DSR rejection rights.


    DSR of course being Distance Selling Regulations.

    I'll let you know how this pans out. Obviously I'll be taking legal advice.

    3.38 Unless you have agreed that they can, your consumers cannot cancel
    if the order is for:

    ...

    the supply of goods made to the consumer’s own specification
    such as custom-made blinds or curtains. But this exception does
    not apply
    to upgrade options such as choosing alloy wheels when
    buying a car; or opting for add-on memory or choosing a
    combination of standard-off-the shelf components when ordering
    a PC, for example
    hmm, seems to me you should be able to cancel under DSR.

    I guess I should leave Scan to deal with this one, but as the systems are custom built, not a base system that is configured to their spec, those exceptions in bold would not apply.

    My right of cancellation does not rely on DSR but I thought you'd all be interested to know what SCAN's interpretation of this is in relation to 3XS systems.

    Could you confirm if Netsolve will be recovering the un-opened boxes from my neighbour (and will it be this week?) or if I have to arrange my own courier.
