    The warranty referred to appears to be one offered by Apple. Manufacturers aren't obliged to offer a warranty at all, but if they do, it's now legally enforceable.

    What appears to be happening here is that there is a remainder of the original (and presumably one year) Apple warranty, and Student Computers are saying it will be at least 3 months of it remaining.

    But you also need to bear in mind the difference between a warranty (or rather, guarantee) and the rights you have, as a consumer, when buying from a business under UK consumer law such as the Sale of Goods Act .... and that applies to second hand goods just as it does to new.

    And shops, as sellers, aren't obliged to offer a warranty at all either, but nor can they avoid their obligations under consumer law.

    To be honest you have completely lost me, shops aren't obliged to offer warranties?

    Nope, and most don't. But they can't avoid their Sale of Goods Act liabilities, etc.

    When you, as a consumer, buy from a shop, you create a contract between you and the shop. Consumer legislation, like the Sale of Goods Act works by embedding certain mandatory basic provisions into that contract, like that the goods must be of "satisfactory quality", "fit for purpose", etc. Those provisions, which is what most of us rely on to get a shop to replace faulty goods, are what most people mean when they talk about warranty, or guarantee .... which also, depending on how you define the terms, aren't quite the same thing.

    Most manufacturers offer a basic guarantee with their goods. You'll often get a little card saying what the terms are. They aren't obliged to offer a guarantee, but most do and, if they do, they can be held to it by a court.

    So, for instance, you buy a XYZ brand of hard drive and XYZ limited offer a 3-year guarantee, but you buy an ABC brand and you get a 5-year guarantee. But .... it'll be a limited guarantee in that they'll stipulate what is and isn't covered. Those are from the manufacturer.

    Say you buy a Corsair PSU from a high street dealer. If it goes wrong, you have you consumer rights to fall back on against the seller, or the guarantee that Corsair offer. The shop can't insist that you rely on the manufacturer guarantee, but it may be the best option sometimes.

    And some shops offer their own unique guarantee. For instance, John Lewis offer a five year guarantee on all TVs (or did, last time I looked). Or, Richer Sounds offer what is really more of a warranty than a guarantee in that you, at your option, pay an premium for a warranty that gives you extra cover in the event of problems. Generally, in my opinion, that type of warranty is a waste of moeny and often a very expensive waste of money, but the Richer Sounds one is an exception and I would seriously consider it and have in the past, both bought and needed to use it.

    Argos also offer a guarantee ..... on most (but not all) products, you can take it back within 16 days (or whatever time it is) and get your money back. They don't have to offer that, but as they do, you can enforce it.

    What there isn't, is what most people think they get which is a 12-month "guarantee" from a shop on all products bought. Imagine Tesco's reaction if you took back a 11 month old banana? Or an 6 month old newspaper because it tore? On the other hand, if you took back a paperback book after a few weeks because you'd opened it and found half the pages were blank or because the print was smudged and unreadable, you'd no doubt get a replacement or refund, and often an apology.

    So there;s a difference between what shops will do if you go back, which is often to be reasonable or more than reasonable, and what they have to do. All they have to do is :-

    - meet their duties under the Sale of Goods Act, etc to give you your consumer rights
    - meet any guarantee they offered at the time of sale, if they did.

    They aren't off the hook if they don't offer a guarantee, but only because of consumer legislation.

    Oh, and those consumer rights give you rights nor for 12 months but for up to six years. The rights might be limited, and sometimes not straightforward to enforce, but they do not stop at 12 months.
