    Its annoying I must admit. Its all up in the air at the minute, thankfully we do have witnesses.

    We had plenty of space until the old bloke moved forward and literally blocked us from going anywhere by stopping parallel to the van, he just sat there waiting for us to go. My wife tried to turn in slowly and edge over to the left to get round but there was no space whatsoever and took out our car.

    Our insurance liability department are saying that he should not have done what he did and it is helpful that we have witnesses. We are progressing the claim at the minute and our insurance are contacting said witnesses and his insurance for the liability. It will probably end up in court I'm thinking

    I got out the car and gave him some serious verbal after it had happened, even the van driver was shouting at him for what he done. Wife on the other hand was stood there head in hands crying her eyes out and just kept saying I couldn't get round, he boxed me in.

    Bit of a mess but just got to ride with it.

    I'm not sure this is entierly true. If the vehicle is parked illegally then isn't the liability split?

    We were told this on our minibus driver course where you are required by law to leave a parking light on if leaving it on the road over night, and if someone hits you if they're not on then you would be half liable. Of course this means you have a flat battery in the morning!

    IANAL, but I believe that the person that answered this is.

    A driver should always be doing so within the speed limits and taking into consideration the prevailing conditions. If the driver is unable to react to a stationary object in the road* then they are driving irresponsibly/too fast. In a manouevering situation, the driver should be observant enough to avoid any stationary object, 'illegally parked' or not.


    *excepting e.g. something which has just fallen from a vehicle in front of the driver.

    "The illegal parking does not absolve your wife for responsibility for the collision I am afraid." Fair quote but doesn't exactly clear up the liability issue, they just drove off after an accident which was the illegal part.

    Housemate's girlfriend works in insurance actually, I'll ask her opinion tonight if she's round.

    Trouble with that is - how many peoples cars have parking lights now? I think some Vauxhalls do, and Audi's, but my 106, our Merc and mums MG don't.
