What to do with V5C/Breakers taken wrong part?

I seem to have a bit of a problem with when my car got taken away yesterday (I was with my girlfriend so wasn't there for the sale)

The guy only took the "New keeper supplement" (section 10).... but it was my old one from when I got it from my granddad

They haven't signed the declaration or any of the paperwork, they were under the impression that I was meant to keep all of it, my parents weren't sure

As it's gone to a scrapyard/breakers to be dismantled I know I need to complete section 9 (sale/transfer to motor trade/insurer/dismantler) and I think section 6 (new keeper) but is there a way I can complete it and send it off without their signature?

Tried to call the DVLA but they aren't open on a monday

Best bet would be to fill in the relevant section, send it to the DVLA with a covering letter as to what has happened.

Make sure you send it recorded delivery, signed for would also by my suggestion - saves any problems when they say they haven't received it

And photocopy everything, twice. Or if you can get to the breakers asap then they should just sign the correct bit and you can post it to the DVLA. They should know what they are doing which makes me wonder whether it wasn't just an honest mistake.

Breakers yard is over 100 miles away, I have no car (until tomorrow but I can't take more time off uni)

It was late at night when they got round to get the car, and he took the bit I previously got as opposed to the V5C

Going to call the DVLA then the breakers tomorrow, worst comes to the worst could I say I dismantled it myself and that it's now off the road?

Also will filling this in mean I get the unused tax back? It expires in July so I presume it's Jan-July I will get instead of some of December too

Not worth going down the route of saying you dismantled it yourself, you are only opening yourself up to potential liability (criminal or otherwise).

You've got to do all you can reasonably be expected to do - if you do that, you haven't done anything wrong.
