The banning doesnt stop the backups from working from what I have heard - it just stops the console logging into Live
Not sure how it will resolve cheating as all the mods at the moment just allow the playing of "backup" games, as far as I know they dont allow homebrew or unsigned code therefore I didnt think it was possible to cheat on the 360 anyway
I've never really experienced cheating on my 360 although people do glitch all the time. Case in point: Gears of War. (Damn that chainsaw glitch)
They will probably find a way around this (unbanning themselves or changing serial or whatever)

Don't you have to pay to use live anyway? So they are denying paying customers with non backed up games from playing them online if they have a modded console? Isn't that illegal?
Well anyway, I'm not too interested in gaming, if I get a 360 it would be for media capabilities - but I will wait and see if anything like xbmc is made by a 3rd party anytime soon (otherwise its htpc)
I wouldn't be at all surprised if there is a clause in the XBox Live! usage agreement that prohibits use of modded consoles...
Agreed. They have their statement all cocked up as far as my understanding goes. "Modded" consoles don't allow unsigned code, they just fool the DVD drive into thinking that a legit disk is inserted when it's not. No cheating there.
They also don't mention whether it blocks users from downloading dashboard updates.

no-one, which is why it can come round to bite you in the backside...
there will always be some way of getting around the ban.
