    Ebay and the Wii

    don't you love ebay?.
i mean they try so hard to protect the genral public from the scammers and dodgy products.

i have been trying to sell a import Wii, ok not just any import Wii but i'll be honest its been modded to play all regions and discs for Wii and Gamecube games, it also comes in 8 different colors (different cases).
now i know ebay doesnt allow copy games or modchips, so i worded the auction carefully as a regionfree wii, i also stated that i dont sell mod chips or copy games. But they still removed my auction saying i breached copyrite and gave a detailed explanation as to what they dont allow, in fact heres the email now.

Thank you for your recent Fixed Price listing on eBay. Unfortunately, these items breached one or more of our policies and had to be removed from the site:

230209947931 - Nintendo Wii™ Console multi region - any colour

Your eBay fees for this item have been credited to your account and all bidders on this item have been notified of its removal.

    Why was your listing removed?

You may not list unauthorised copies of media on our site because selling them is both illegal and against eBay policy. Unauthorised copies include (but are not limited to) backup, pirated, duplicated, or bootlegged copies of software, video games, music, films, television programs, photographs and books, both published and unpublished.

Copyright owners possess the exclusive right to reproduce their copyrighted work, to distribute copies of their copyrighted work, and to perform or display their copyrighted work publicly.

Guideline: If the product you are selling is a copy of another work that you aren't authorised to copy, don't list the item.

eBay prohibits the sale of items that can copy or create a backup of video games, including:
    - mod chips
    - softmods
    - game enhancers
    - boot discs

These devices are designed to bypass copyright security systems, allowing users to produce unauthorised copies of games. This is against the law and violates the rights of the copyright owner.

now i wasnt being dishonest in my auction, i was just not mentioning the fact its been modified, how can ebay just jump the gun and remove it when i havent said anything?.

    Re: Ebay and the Wii

so they can just remove auctions if they feel its something else.
on what grounds can they do this, i mean what about somebody whos genuine and is selling something and it gets removed because ebay suspect its something else.

i had an issue over a year back with a ps3, i bought one from hong kong and didnt like it so tried to sell it, ebay removed it saying i didnt provide a reciept, i didnt have one as i imported it and threw the invoice/receipt away. but that didnt stop them from assuming i am a scammer.

    Re: Ebay and the Wii

Perhaps this is a catch all email that gets sent to people who try to sell modded consoles, copied games etc.

You can have no complaints with ebay as you were doing something against their terms and conditions.

    Aka Illegally modded console.

They're not morons, when what your doing could land them in trouble. I wouldn't be surprised if it had been pulled at the request of Nintendo.

    Re: Ebay and the Wii

I had a similar situation. I was trying to sell some WWE DVDs and wasn't allowed to sell them worldwide (despite them being NTSC) due to copyright restrictions. Once I changed the postage to just UK, everything was fine. eBay is really cracking down on stuff like this.
An Atlantean Triumvirate, Ghosts of the Past, The Centre Cannot Hold
The Pillars of Britain, Foundations of the Reich, Cracks in the Pillars.

My books are available here for Amazon Kindle. Feedback always welcome!

    Re: Ebay and the Wii

Do Nintendo sell region-free Wiis? If they don't then a region-free one must have been modded. It sounds fair enough to me. It's not just about selling the actual mod chips:

...which is what your console does.

    Re: Ebay and the Wii

Yup, it's not like they pulled your auction at random, they know what region free means and sounds like they are sticking to their Ts & Cs. Just remember that eBay is a power unto itself and they can basically do whatever they want, there's no point arguing with them because it gets you nowhere.

I was selling a recording interface on eBay and it got pulled because I had posted 2 links to external sites (reviews of the unit btw) where you're only allowed 1 link apparently. Funnily enough, there was another unit selling at the same time which was more expensive and not brand new like mine was, I suspect someone got a bit upset and reported me. Didn't matter, just reposted it to end an hour after his so he didn't get any bids

    Re: Ebay and the Wii

My wife had her three PSP game auctions pulled yesterday by Ebay as she was told you cannot use the words "As New" in your auction.

She was credited and now has to re do all three listing..

Think of the upside, you got to post up a nice advert on here
    |Kata: "Read title as 'fisting'. Not sure why I clicked. Relieved, really."|
    |TAKTAK: "It was so small that mine wouldn't fit into it"|

    Re: Ebay and the Wii

haha good point, wasnt the intention just get piss3d off with ebay.

i sold my car last year and i posted pictures which originally came from pistonheads, thus had a small 'pistonheads' on the corner of the picture, no big deal right.........NOOOOOooooo got removed and told that i cannot have other websites listed on my advert.
so its gone from 2 links not allowed to NONE all of a sudden.

god i hate them, yahoo auctions dont give a *#@* and allow any old thing and because of it, its more honest and upfront about everything.

Especially as we all know that pr0n makes more money that Hollywood and the games market combined!
