    Some twit drove into us!

    Today on our way to get some wallpaper some muppet on a moped went into us! But thats not the best of it,

    We was at the round about stationary he was behind us, my mother slowly crept forward readying to go and smack, we have had a massive jolt! get out to some half witt behind us looking all dazed and out of his face...and the rear bumper is cracked with aload of paint missing...yet it was a damn moped that did it! i mean how? how can a moped do that to a car...

    Either way i told the chap (who look mighty shook up btw) to just follow us down the road to get out of the traffic, he did so and we exchanged details, i told him i would contact him later on to sort it all out.

    Called him up asked for his insurance details.....this is where it went wrong he at first gave us his L plate number and when i asked again about his insurance details he replied with "i dont have any"

    I politly said ok and "goodbye i will be in touch" phone the Cop shop with the Numberplate in hand....turns out he gave me the wrong details! fuming i contacted him back and asked him to repeat the number plate which then changed! unbelievable...

    Either way he turnt around and said this (get ready your not going to believe this lol)

    It's not my fault i didnt see you"

    i mean really? what you didnt see a electric blue car? jesus...this then changed to it being my fault for stopping, well dur its a roundabout i couldnt go! which he then said again that he didnt see me...

    now its a few hours later and just had a call from his dad who has given me his landline and details, he wants me to take the car up to his so he can see if he can get the replacement parts, there is one problem, the car is making a knocking sounds (pretty loud we dont know what it is) and although he may be able to repair the bumper its this knocking sound that bothers me.

    now im almost 100percent it was not in any way my fault, and that this half witt doesnt have insurance and his dad doesnt want us to go to the police,

    You have all the contact details you need. Shop him. And come to terms with the fact that you'll probably be footing the bill for this yourself, but at least you were able to notify the police.

    Yes we have gone to the police, really sucks, the car is only a few months old

    It's why, even minor, I called the police when a girl went into the back of me. (I say minor.... my car was written off and both my and my gf have to see a physio for whiplash and I have torn muscles in my shoulder)

    Still trying to sort out the insurance claim though.... and she had insurance (they can't even get the dates of the accident right!)

    If he was out of his face I wouldn't have even waited until I had gotten out of the car before calling the police to report it

    Doesn't matter - there is an offence of driving under the influence of drugs, with similar penalties. You should probably report it to your insurance company too. The damage may be more than you think. However you may lose your NCB if the other driver has no insurance, although (I think) there is a compensation scheme run by the insurance companies (and effectively paid for by drivers that do have insurance!) to cover cases such as this.

    Do you have any photo's of the damage, to both vehicles ?.

    If not, and you have the other parties postal address, get round there quick and see if the moped is about and take photos of the damage to it before it get's magicaly repaired and they deny all knowledge of any accident at all.

    Yes it's paranoia but you never know what could happen...

    Ok, insurance company have told us this, if he accepts it was his fault then the insurance will pay all costs and claim it of him, however if he denys it being his fault then they want us to pay £250 excess! damn rip of this insurance rubbish either way he couldn't deny it really, we have his paint on our car. It has also already been reported to the police so he would have a hard job sorting it.

    when to the garage today and was told that to repair it all, it would cost us £570

    It's not, you should have still called the police if you had even the slightest inkling he was under the influence.

    That isnt too bad, mine was nearly £2000 on mine in a low speed accident so my car was just written off as Cat C

    AFAIK you'll pay the excess first - then insurers will seek to get payment from his insurers. If it's "non-fault" you get the £250 back. The insurers would decide between them who was at fault - you, them or 50/50.

    Of course, he has no insurance...

    What Is the MIB (Motor Insurers' Bureau)

    The Motor Insurers' Bureau (MIB) is a UK Guarantee Fund that compensates victims of negligent uninsured or untraced drivers (commonly known as Hit and Run accidents). The Motor Insurers' Bureau is funded via insurance premiums and the typical cost is £15-30 per policy. Compensation paid out since 1946 is in excess of 2 Billion pounds. Administration costs alone have risen from 11 million in 2004 to 19 million in 2006.
    What does the MIB (Motor Insurance Bureau) pay compensation for?

    The Motor Insurers' Bureau will pay for bodily injury suffered by victims of negligent uninsured or untraced drivers and there is no limit to the level of compensation.

    The MIB will also pay for property damage as a result of negligent uninsured or untraced drivers. If the damage is a result of an untraced driver then the MIB will not pay the first £300.00 and will treat this as an excess. If the damage is a result of an uninsured driver then the £300.00 excess does not apply.

    This is 100% correct, it's exact the procedure followed in an accident that I was involved in (the other party eventualy admitted that they were at fault, but only after I heavily pushed my insurer stating that I want to attend court for a judge to decide as the evidence against them was damned near irefutable !).

    And until the other party admits liability, or a court is able to issue judgement in default (the other party fails to acknowledge court papers served from your insurer), or a judge finds in your favour, you will not get your £250 excess returned

    ouch...this sucks big time huh. Well i've spoken to the father who is willing to pay for the damages, not sure what the police are going to do about it though as they already know about it...oh well his fault not mine!

    P.S: I hope our insurance company doesn't decide to try 50/50
