what kind of car do you have? what kind of car is in the photo of you speeding?
techically, under the Data Protection Act, they HAVE to show you any images that are alledgedly you BY LAW if asked for. THEY CANNOT REFUSE, to do so is BREAKING THE LAW (play them at their own game) therefore if you can show that the car photographed is clearly not your car (the one you're registered to)then you're off the hook. until then its always their word against yours. and if you NEVER recieved anything unitl the recent 'come to court' letter then you can argue that as well.
on a more personal note get really stroppy with them over mis-spelling your name and explain to your disgust that such a thing could have gone un-noticed for such a long time and (providing that you have shown that its not your car in the photo) that its such an inconvienience to have you called into court at such a time. not just to you but also to the magistrates (it costs them money to drag you into court too, so if you don't need to be there then thats saved them a bit...)
hope that helps...

or alternatively, go to the court room, be nice and polite and explain that if it is your vehicle then this is the first bit of correspondance you've recieved on the matter and you would like it being dealt with as quickly as possible. if they wont throw the case out then explain that you'd like it dealt with as if the court order was the first action letter and you'll recieve the points and fine like a good boy..
personally i wouldnt get stroppy over any details.. i wouldnt start shouting your mouth off about this law and that... I wouldnt actually do anything that shiato storm has suggested!!!
Thanks for all advice, and as you say Kallium, thats probably the best course of action - according to a nice chap at the North Westminster Fines office, the very fact that I haven't physically recieved any notification of the offence it enough to get it thrown out - but we'll see.Originally posted by kaillum

fair enough, it may be that since you've only just got notification then being so old etc can be dropped. its technically up to them to notify you, since they hadn't - who's to blame?
and is 'cloning' number plates a recognised offence yet?

Creating a ringer has always been an offence.
right, but would they accept that in court if you walked up and said "wasn't me honest. it must have been a clone of my number plate..."

So .....was it you then?
Do you travel that route?
I've no doubt it was me - however having not been informed of the offence for over 18 months and not having been given the chance to contest it - I'm contesting it.Originally posted by doopydug

omg!!! you have a Ukranian pen pal too??
Ooooh I never gave you guys an update on this did I ?!?!?
Well
I went to court.
My first time ever - I got called and walked into this big old room with 2 very posh looking old blokes in pinstripe suits and half-moon specs ...staring at me as I sauntered in not knowing where the hell I was supposed to go - usher bloke directs me to the witness stand where he gives me a bible and asks me to swear to some bloke called God to tell the truth.
Case no. blahh blahh defendant charged with offence - th clerk of the court takes the bit of paper off me detailing the fine and the date of the offence.
'What was the offence ?' asks one of the judges
'That is unclear right now your honour' - turns out not even the magistrates court didn't even know what I'd done wrong.
Looked at me and i said 'buggered if I know' in a more polite way
Pleaded a Statutory declaration - judges accepted it , case thrown out.
Judge advised me that the issuing Borough might pursue it if they want to, but unlikely.
2 months later I've heard nothing
rubbishrubbishrubbishrubbishrubbishrubbishs
well spent tax payers money, right there
Congrats on avoiding charges though!
Just as belated as the courts request, eh?Originally Posted by Skii
Well, even though you all know my feelings on speeding, it serves the courts/police right for waiting far too long. Grats for getting one up on them!
One court case I was supposed to be a lead witness in (a drink driving incident) is now 15 months down the line and I still haven't been called to the second line-up (he didn't arrive at the first last year). Just goes to show how lame they are...
