    Parking Tickets

    Hi,

I recently received a parking ticket for parking outside my house. Nearly 8 years ago now there used to be a bus stop there. The bus stop has since been removed but the single yellow line remains. This means I can not park there between the hours of 8:00am and 6:00pm.

I challenged the ticket as the line has no reason to be there since the bus stop has been removed and also the yellow line is incomplete as it has worn off over an old grid.

The CPS have wrote to me telling me that they will not consider my appeal and to pay within 14 days.

What do you guys think? Are they correct or am I being stitched up?

They're correct as you parked on a single yellow line. It sucks big time but such is the stupidity of modern bureaucracy...

i won my ticket due to worn lines, took it to court and the magistrate ripped the copper to bits for having no evidence to support it.

Always back an appeal up with pictures - the CPS can just say "The line's FINE, oh and PAY US NOW!!" But if you have a picture to back it up - ie the line's there but not correctly terminated/worn off/painted on the road wrong etc then they can't argue.

Parking tickets are a con job, its a money/revenue raising exercise by the back door.

It shows you how much intergrity the local authorties and politicians have, they should just own up.

Much easier to pay, consider it another form of legalised loan sharking.

    Just my 2pence worth.

I got one not long ago for parking on a verge near work. I came back and the ticket had a strange code on it, so I rang up the local police station to query it. Turns out the code was for "driving on a verge" and according to the police website a driving offence cannot be issued in the drivers abesnce.

So i asked them, is that a driving offence or a parking offence? no clear answer. So she calls a traffic cop, and apparently because I "must have" driven on the verge then I could be issued with it with out being present. I think thats a load of balls tbh, so I have challenged it and they have given me the 14 more days to pay up. I am going to leave it, and point out that :

    1. I didnt drive on there, I and several colleagues pushed it on there due to an "unexpected" brake down.

and 2. I wasnt present so they cant issue me a driving offence.

I think they are full of it and cant win this one.

Everybody should fight these tickets, the worst you can get is £60 plus costs, even then I could say that i have commitments oin my income and I want to pay monthly or whatever.

Can't speak for where you live but I am 100% sure that in Glasgow it is not an offence to park on a verge/pavement (unless in a dangerous position).
It is however, an offence t o drive onto the pavement but they have to actually see you doing it & it has to be a police officer & not a traffic warden.

Are you serious? Just because the line is broken by a storm drain, you are considering contesting your fine?

I'm no legal expert but I would imagine that standing up in court and claiming that you did not know the line was there and that its condition does not meet legal standards would only work if:

    a) the line was actually worn, whereas Stevie Wonder wouldn't have parked on that one.
    b) the line was not positioned directly outside the house where you have lived for at least eight years.

Seriously if you try and contest the ticket on the basis of that picture you are nuts. Pay up now, especially if the fine increases if you don't pay within x days. If you think the line shouldn't be there then speak to the council/highways agency/whoever and see if they won't agree to remove it. Just trying your luck by parking on it from time to time could work out quite expensive in the long run.

I thought the laws were that the line had to be complete? The photo is to demostrate that the line is broken?

OK then, have your day in court and let us know how you get on

You'd better be ready to explain how it is that you could you ever have a completely unbroken line that runs across a storm drain though...

JPreston, you were wrong my friend. I have had a letter of the CPS saying that the line was indeed in breach of the regulations and so they have cancelled the ticket!

    Power to the little people!
