    You can't do anything.

    In their terms and conditions that you agree to they state that they can change their policy and terms and conditions at any time.

    By signing up you agree to this. They can do this. It's legal. It's not false advertising - it's an agreement - a binding contract for a service they provide.

    As for advertising claims - when they advertised they did actually offer an uncapped service so they're all above board there. If you go to sign up now it tells you that it's capped. They point you to the T+Cs.

    Please dont advise on something you clearly know absolutely nothing about.
    If they put "we can send a hitman to kill you if you use too much bandwidth" in the contract does that make it legal

    Believe me they have lawyers who draw up these things that know a fair bit more about UK law than you.

    Companies will always put terms and conditions in their contracts that they know are not legally enforcable as they know that the vast majority of people like you will just see them as above the law.

    I once bought a car and the trader wrote on the reciept "sold as seen" and "warranty declined" before signing it. The award for nearly £3000 that I got suggests you are talking from your behind.

    You have further proven you have no clue whatsoever about how law works by even suggesting that putting a clause in the contract allowing them to change it means they can make any changes they want and its tuff sh1t for you.
    Changes to contracts (unless very small) have to be agreed to both parties, and if not, depending on circumstances, one party may be forced to honour the original terms or the contract becomes null and void.
    e.g. If Plusnet doubled the cost a month after you signed up, do you really think they could legally enforce that?

    Terms and conditions have to be reasonable.
    Freeserve tried to apply caps to their old customers - they didn’t get very far when trading standards got involved. A couple of weeks later and all previous customers have a letter through the post saying that they wouldn’t be included in the capping

    Contracts can be changed, but if it differs significantly from the original one, you certainly do have grounds to cease it.

    I used to talk with the guys over at trading standards quite a bit a few years back, nice bunch. Your best bet is to pop along and see them

    I joined plus net the very begining of 2003 and had no problems atall. Their service was fine and there network wasnt oversubscribbed. Tbh at the time they were excellent 24/7 customer support and you got a half decent web hosting package with it aswell.
    I never had a problem with them.
    I decided it was time to change over to another ISP in november one thats not aswell know as Plus.net that offers me a much better service. I actually came across it via a forum i am signed up to (www.rubbishrubbishrubbishrubbishrubbishrubbishrubbishrubbishrubbish.com) they had a deal with IDnet, so i spoke to a few people who were on it and they said it was excellent so i decided i would move over to them. They are an excellent ISP a good replacement to Plus.net.

    I cant say i ever had a problem with Plus.net. They gave me my Mac code when i wanted it and they even let me change over to a monthly contract for free. When i migrated they said they would refund the month i had just started because i migrated 1 week into a new billing month. Actually they never did refund that but i cant really be bothered with chasing that up as my new ISP offered to give me that month for free any way after i explained the situation.

    I feel sorry for Plus.net they where really good and i am not sure what has happened to them. This is just the problem you get when you become a very popular. It may be that their network is at full capacity and they need to find ways of limiting the bandwidth.
    Makes me wonder how much money they have invested on their infrastructure, because they did buy out that ISP not so long ago(cant think of their name) Meaning alot more users on their network.

    just one thing to say now really... IDnet.net FTW !

    How do you pay?
    IMHO you should block the payment and let them chase you for it. If/when they try to take you to court for it, you have the chance to make a counter claim at no cost to yourself. Claim breach of contract under the Trade descriptions act 1968.
    If you need more detailed advice, let me know.
    I think I pay via direct debit. I know this is easy to cancel. But what worries me is that they say that if I cancel, they will send two letters, then the heavy mob will appear.

    How would I claim breach of contract?

    The heavy mob have no power untill they have a court order. Though I dont know how plusnet work with debt recovery the most likely thing is they will get a "debt recovery" company to try to recover it. They will send a few letters with threatening undertones that you can either ignore or respond to telling them to stop threatening you and if they want some money they can take you to court.
    The only way to claim breach of contract is to take them to court for money paid which IMHO wont be doing yourself any favours or for them to take you to court. The likelyness of them taking you to court depends on how much money they think they can get out of you if they win.
    When I had Blockbusters debt recovery company chasing me they sent all kinds of letters promising eternal damnation etc but unsurprisingly, they just went quiet after a few letters and a stupid trick to attempt to get me to contact them.
    It said URGENT! it is vital you contact us on this number immediately quoting this ref and not a lot else. They had a company name on the slip though and a quick googling revealed they were involved in debt recovery. I was tempted to phone them and waste their time, but couldn't be bothered in the end
    One final thing. If in doubt at any stage in this you do get people knocking on your door (which is unbelievably unlikely IMHO) simply tell them where to go.

    Before reading the next part, I am just saying this to put your mind at rest WRT bailiffs and things. I do not think there is any chance of them paying you a visit. Its too costly as large intimidating people are expensive and most of the time when they visit the premisis will be empty. I have never heard of heavies being sent in for small debts before any court case.

    Bailiffs are like vampires, you have to invite them in and they cant just take stuff from your house. If they are legit, they will get the Police in to help them who do not need to be invited in if they know you are present. Of course as soon as you see police you know they are legit and can allow them in (or better, meet them outside) and avoid Police forcing their way in.

    Just finished reading this thread.. I am shocked, I only signed up for Plus.net about 5 months ago.

    They still seem OK right now, good speed etc... no letter yet. I just don't think I've hit the limit yet. Going to have a good look on they're site now.

    I'm sure when I signed up it was for a 1 month contract where I couldn't leave Plus.net, then after that I can leave for free... are you telling me if I want to leave I have to wait for the full 12 months then pay a fee?

    Badass: WTF does some dodgy 2nd hand cars salesman writing on a receipt have to do with a large telecoms provider changing their T+Cs?

    This has been brought up time and time again, was brought up when BT changed their dialup timeout to 2hrs. Was brought up when dialup co's started banning people for overuse. Was brought up when broadband providers started to disconnect people for overuse. Was brought up when NTL introduced caps. And now we're seeing caps etc. on ADSL.

    Check out ADSLguide for posts like yours - threating to bring down the law on them. Nothing happened.

    I think Agent is right - it's all about "reasonable" changes. Allowing capping will defo be seen as reasonable because so many providers have done the exact same thing in the past.

    Law is based on past cases.

    Case closed.

    Traffic management and the PlusNet network
    ------------------------------------------
    8Mb speeds are almost here and applications such as iTunes, Video on Demand and media services such as Sky By Broadband are all taking off.

    What does this mean? Well, it means that the old style of network management doesn’t work anymore. ISPs have typically taken no notice of what traffic is passing through their network - they have simply hooked up more capacity to deal with increasing demand. This has been possible previously due to significant annual reductions in the cost of purchasing capacity from BT Wholesale.

    This approach to network management does not work when someone in the home is downloading high definition video, someone else is making a phone call using VoIP and someone else is browsing their favourite websites. Their service would simply grind to a halt. ISPs instead need to prioritise certain traffic to ensure no drop in quality for time-sensitive applications.

    Over the past 12 months we have been developing our network management capabilities to deal with this ever changing challenge. We recognise that some customers have inadvertently seen the adverse effects of us developing these capabilities and for that we apologise.

    The focus of our development has been the management of a small number of customers who are using disproportionate amounts of capacity and driving up our operating costs. We introduced new allowances for Plus and Premier customers in December which means 95% of customers get improved speeds throughout the month, and that heavier usage customers are managed at peak times. Significant progress has been made on this work and we are almost at the point where Broadband Plus and Broadband Premier are being used as intended.     I signed up with Plusnet some time in November and chose the 4MB plan as I wanted to use the higher download limits, and in my first month I did around 130GB

    The only catch here was that I had to manage my peak usage during 4pm and midnight to be under 45GB for the whole month and come on, who needs a 4MB line if it isn't for P2P?

    I was suprised last week when I got an email from Plusnet stating that I'm currently under Level 1 Managment. To explain the scam this is how it works. Apart from the whole 'main' data transfer peak time of 4pm to midnight, they've decided to class all Usenet, FTP and P2P bandwidth it its own peak time band of 8am to midnight, and during this time you can only download 30GB for the whole month or else you get managed. Right now I'm on Level 2 which means all P2P is clamped @ 256KB/s or approx 30KB/s. I'm pretty sure I'll be seeing Level 3 shortly. So this means you have to schedule all your downloads to take place from midnight to 8am - and this SUCKS!

    Let's say you've hit the 30GB mark. Now from this point onwards you are being managed. 8hrs/24hrs * 100 = 33.33% of the day can you use your connection to its full potential, and even for a month, this means you get to use it for 33.33% of the whole month, which works out to 9.99 days, or 10 days rounded off. So for 20 days of the month you're pretty much screwed. I used to enjoy being able to suddenly have that latest episode of Naruto go at 240KB/s but no longer will I be able to enjoy this

    Now can I leave Plusnet? Sure, if I pay £47 to terminate the connection. Frankly I'm quite annoyed with Plusnet but considering I'm only going to be in England till June, I'm gonna bare up and manage my downloads from midnight to 8am and see if I can survive

    Simply put, DO NOT signup with Plusnet, you'll regret it

    P.S. S29Feb: Thanks for your post - I've copied PlusNet a similar email with alterations to what you have said. You're right - this is a breach of contract and I shouldn't just drop it and 'play along' after all I'm PAYING them! Will keep you guys updated on their reponse, if they respond at all that is.

    Just because something is written in a contract and you sign it, doesnt mean you are
    bound to it. If there is something unfair then it cant be applied.

    I forget the correct terminology for that.
