Fitzgerald was picked up by Police, Cumbria Trading Standards and an ELSPA investigator in April 2004 when, trading as ‘www.mods-and-sods.co.uk'. Today he's been convicted.

Makes no sense, how can you convict someone of modifiying the hardware? Its not his responsibility what people use it for.

Take a chipped Xbox with XBMC for example - it doesn't have to be used illegally, its just a lot of people do.

Right this guy goes to court, but the hundreds of eBay scammers and companies like the much vaunted westavon-systems go unpunished.
