    I got compensated about £1200 for whiplash when somone ran into me (from their insurance not them). I didn't have to go to court, everything was handled by the insurance company and lawyers they appointed. I did have to go to an independent specialist (again no money spent by me) to get and independent review of the injury but that was the only bother I had.

    Do not worry, just let your insurance company deal with as much as possible and help them out with as much information as possible.

    And yes your insurance will cost more for a few years even if it does go through as no fault like mine did, life sucks what can I say!

    thank you all for your comments, i feel less anxious about the whole situation now.

    Im not actually with the same insurer, when the time came to renew i chose the cheaper option of moving elsewhere. But ive sent off my citation off to my old insurer who are still dealing with the whole thing now. does it matter that ive changed?

    I am fully comp, always have been, think it saves alot of hassle if you are to have an accident.

    Just think the whole thing is a bit messed up to be fair i think the justice system has alot to answer for. so i guess you could say im angered even though i wont have to pay..... its the principle!

    At the end of the day everyone should have the right to air their grievances in court if they feel they've been hard done by.

    But if the facts of the case are as you presented them (I.E. she hit you while you were stationary, and she had no good reason to drive into you), and you've got an independent witness backing you up, you have absolutely nothing to fear, because she'll be laughed out of court if it ever gets that far. The greedy lawyer who's backing her will suffer a significant loss, and all will be right with the world.

    Its bad enough dealing with these matters in a moving collision, but if you were stationary and this can be proved it makes things a lot easier for you.

    I agree, everyone should have a right to air there grievances. I was going to write to our local paper about the so called reverand, then i thought whats the point, no point in lowering myself to her level.

    a while back i recieved a letter from my insurance company that she had sent them, she had been out taking pictures of the junction- which is fair enough.... the cars she had taken pictures of were all turning right, as i intended to do.... but the pictures were of other cars pulling away in front in the nick of time and she was saying that this is what i was trying to do. I think the fact that she hit me head on, and not in the side as she would have done if i pulled in front of her as she claims.

    she then went on to say that i must know this witness on a personal level, and i was having a realationship with him.... the woman is an absolute chancer! She said that before the crash that this man (witness) who was next to me turning left/ straight on lane....was staring into my car...peering at the two young girls (me and my friend)....does that statement not prove that she was infact looking at the gentleman beside me and not where she was going at the time of the accident?? My friend was also pregnant at the time, so for me to have taken a chance with her in the car would be unthinkable....

    She then went on to say her status was at stake and she would not back down.

    Like i said previously im not worried anymore, i know that this whole thing is a farce....but obviosly when the citation came in i got a fright thinking i was getting sued for ten k!!

    She obviously has the same view on young drivers as most people and thought if she made up all this my "young driver status" would go against me and she would win all the way.

    i dunno but im thinking maybe shes scared because shes an older driver.

    Bring it on Young driver vs Old driver.......cant wait!!!!

    and also i must tell you guys, i work at the local hospital. I was walking back from my break the other day and i happen to see this woman pulling an elderly gentleman out of the car....guess who it was!!!! If her life was turned upside down and she cant even walk to the shop or do her photography and leisure like she said in the citation i recieved then how can she physically pull an overweight man out of a car....and take pictures of a junction...cos that comes under photgraphy...does it not?

    Im not saying that everyone who has claimed whiplash doesnt have a claim, cos im sure it very very common thing to get after a crash, so i feel for you all and well done for claiming money that is rightfully yours....its just in this case this woman is just chancing it, she just want to end her retirement in barbados or summit

    Phone your insurance company and let them know about that. They will probably send out an investigator to watch her for a few days

    Yeah, if they suspect fradulant claims the can send out an investigator, same happens to folk that claim disability benefits illegally.

    Wooo, get her nailed to the wall (cross?) for this!
    I hate these fake injury claims..

    I wonder how she feels standing up infront of her congregation preaching "Judge not, lest you be judged!"

    I know of a guy who went through a turn left lane at a junction and tried to go straight on, he ended up going into a barrier, and hit a young lady who just happened to be along side him when he made his crazy manouver. (My aunt was an independant witness, one car behind the accident)

    He ended up taking it all the way to court, after a number of months, and on morning of the case, dropped it?! I think he was just hoping it would get dropped or go knock for knock if he questioned it, and argued enough. Such a waste of time/money and stress!

    Yeh i think alot of people do that.....like shes asking for ten k in the hope that she gets at least two? or her lawyers 4 u people are! shes not got a leg to stand on i realise that now......stress tho, its been going on for over a year!! argh

    then when it comes to court day......there like oops. they just want to see how far it will go to make my insurance back down.....not gonna happen tho.

    If she's going to lose 10k because of her whiplash (through lost earnings or whatever), IMO she's acting out of desperation to try and recover her losses. She probably knows it's her fault but if a 'no win no fee' lawyer type is willing to try it on for her through the courts she has little to lose.
