Thread: Do I have any kind of case here? (Parking ticket)

    Do I have any kind of case here? (Parking ticket)

    Been parking at the front of my house for 2 years now.. as do most other people on the same block on the road. However this morning I guess everyone had gone to work and mine was the only one left on the road, and I got a parking ticket..



    It is a busy road but people manage to pass by absolutely fine, and the only line markings are slight dashed ones and there is even a big gap where I'm parked!

    The only thing I could see affecting my case is it is an urban clearway... these signs were put up about a year ago but nobody ever paid any attention to them...


    So is there any point in trying to appeal?


    Oh and the description on the ticket says: "46 Stopped where prohibited on a red route or clea"
    I'm guessing they mean 'clearway'. The time says 9.23am....

    Looks like despite not being on the yellow-line you're a bit stuffed on that one

    Sign says no parking at the time you were parked there.. it's a clear sign, and you've noticed it some time ago.. can't think there's anything obvious to go on. That celeb lawyer might be able to get you off, but otherwise easier to pay up quick.

    Not sure if the yellow line appears to the urban clearweay area, but that yellow line is not legit, it has no terminator

    You have already shown a picture to prove this, so if the line is in the applicable area (and what the sign applies to) it's not enforcable

    Yeah, the signs should be accompanied by road markings and none of the road markings there are legit. Your problems is that when you appeal and win, guys will be down the next day to sort the lines and the traffic wardens will target the area. Its all about revenue.

    I know. Like I said me and about 5-6 other neighbours park in the exact same area and it never causes problems. It's a wide road and cars can get past easily without needing to go into the middle of the road.

    Well if the ticket can't be enforced then I want to appeal! Why should i have to pay if I can appeal and not pay?

    It's the first time they have visited this area in 2 years, they were down all the little side streets where the cars were parked half on the kerb... sure it is illegal but if they parked properly you wouldn't be able to get down the bloody street! Besides, I'll just keep my car there so they can't paint the lines

    Playing devils advocate here....I don't think the issue is that you were/weren't parked on a yellow line. Doesn't a clearway mean that that doesn't need to be any yellow lines and that is what you were penalised for? Not 100% sure on this though.

    How far away is the sign/signs from where you were parked? Same side of road?

    post it over at forums.pepipoo.com (Parking and Decriminalised Notices subforum) get best advice there, you'll need to scan your ticket as well (front & back) - the worst you may have to do is ask for the TRO order/documents - councils are reknowned for slap-dash jobs.

    Just because you find a flaw doesn't necessarily mean the council are down the next day fixing things... council's move slow.
