Lovefilm? I've received a copied disc!

I appear to have received a copied version of my requested title... Anyone else had this?

Back of the DVD is the purple ala DVDR, around the center ring is ZD5518-DVR-J47F4 (Verbatim 16x DVDR) and the front of the CD is so clearly DIY labelled. Yet this label is still stamped with the Lovefilm sticker...

Bizarre! But I'm wondering if they've broken any laws here? I was under the impression backups were actually illegal! Despite the talks of "you're allowed 1 backup for personal use blah blah"...

Theres also the fact that the copy protection has been removed.
The fact that the dvd has been compressed, reducing the quality.

    Quite an interesting one, no?

Sounds to me like someone has ordered it off Lovefilm, copied it, and sent the fake back and keeping the original.. then some fool who checked the disc on Lovefilm's end thought it was genuine (or maybe wasn't checked at all) and put it back on the shelf for the next customer..

When you send it back it wouldn't suprise me if they accused you of making the fake tbh. Could turn nasty?

I guess there's a way you can check when the disc information was copied. If it was before you rented it out then I'm sure they can note it wasn't you, but then again if they failed to spot a copied disc then you might be in for some probs.

Backups of DVDs (and audio CDs) are illegal, at least they are in the UK. That 'backup' exemption applies specifically to computer software. Assuming, of course, that the disc is copyright and that the copier doesn't have permission to copy. If I make a film of my holidays, shove it on DVD and put it in the public domain, it wouldn't be illegal to copy it. Strange, yes, but not illegal.

But it's not necessarily broken any laws. It's only illegal to copy copyright material if you don't have the permission of the copyright owner. The chances of them having such permission, however ....

And that, if I remember correctly, puts it firmly in the realm of criminal offence, rather than just a civil matter, if it wasn't already (which would depend on who did what).

If they can't prove they didn't send you a dodgy copy, then they can't prove that you made the dodgy copy.

And seeing as they sent you a dodgy copy, clearly they can't prove that they didn't do so, because if they could... well... they wouldn't have done it!
